Civil society urges Parliament to not approve changes to Criminal Code regulating quarantine during epidemics
The Albanian civil society has come out against the government-proposed changes to the Criminal Code to toughen criminal sanctions on citizens who violate the restrictive measures imposed under the state of natural disasters, such as the present COVID-19 outbreak. In a press statement issued on Friday, some 30 civil society organizations (CSOs), a number of them specialized in human rights’ protection, said that the government’s latest effort to modify the Criminal Code violates the human rights and basic freedoms of citizens, and thus asked the Assembly to repeal the said amendments.
The CSOs are particularly concerned with some extremely harsh criminal sanctions envisaged by the said provisions, including prison terms of 15 years for certain violations of restrictive measures. “In our view, the criminal sanctions to be added to the Criminal Code are disproportionate, do not respect the principle of humane treatment and violate the freedoms and rights of citizens,” the statement read.
In conclusion, they expressed the belief that the principle of humane treatment and respect for human dignity sanctioned in the preamble of the Albanian Constitution should prevail over any law-making initiative, especially in the present context of a natural disaster. Several parliamentary opposition MPs, including Democrat MP Rudina Hajdari and Independent one Ralf Gjoni told ABCNews TV on Monday that the parliamentary opposition will vote against the said Criminal Code amendments, after finding them as extremely severe, unjustified and unnecessary. The Parliamentary Legal Affairs Committee will review the said amendments in a meeting scheduled for today.
