Dacic: Serbia “Absolutely Against” Straining Relations with

Serbia expects Montenegro to take into account the rights of the Serbian people in that country and to avoid any moves that could provoke conflicts, Serbia’s Minister of Foreign Affairs Ivica Dacic said on Monday.

Commenting on the increasing tensions between the two countries over the announcement that Montenegro will adopt a new law on freedom of religion or beliefs that also envisages the seizure of property of the Serbian Orthodox Church (SPC) in case it cannot prove the ownership of it, Dacic said Belgrade was “absolutely against” straining relations between Serbia and Montenegro.

The draft law on freedom of religion or beliefs stipulates that all religious communities, including the SPC, shall prove that they were the owners of church property before 1918 and that it will be seized from them if they cannot prove it.

The Venice Commission, a consultative body of the Council of Europe, announced on Monday its opinion on the draft law, which says that it “brings important positive changes to the existing, outdated legislation”, but it also points to “a number of substantive issues, notably with regard to church property”.

The Commission “understands the concern of the Montenegrin authorities with regard to bringing legal certainty and addressing the issue of alleged illegal/abusive registration in the name of religious communities in the 1990s of a number of religious immovable properties which may be part of the cultural heritage of Montenegro”.

“The draft law should clearly mention that the change in the title over the religious property will not automatically affect the pre-existing right to use such property. The state has, at any rate, the right to impose strict conditions on the use of the property in order to protect the cultural heritage”, the Commission said.
