Presidential pardon and links to Hunter Biden's role in Burisma

US President Joe Biden pardoned his son, Hunter Biden, days before he was sentenced on firearms and tax-related charges. The presidential pardon happened despite the fact that Biden had stated several times that he would not pardon his son.

The sweeping pardon, made public on Dec. 1, absolves Hunter Biden, 54, of any crimes he may have committed between Jan. 1, 2014, and Dec. 1, 2024.

That period includes Hunter Biden's controversial role as a board member of Ukrainian natural gas company Burisma Holdings, a role that is at the heart of Republican criticism of Joe Biden and was at the center of two impeachment proceedings against Donald Trump, former the president who will return to the White House in January.

Hunter Biden joined Burisma's board in May 2014, less than three months after Ukrainian President Viktor Yanukovych was ousted and fled to Russia following mass Euromaidan protests over official corruption and his decision to to undo plans for a trade deal with the European Union and to have closer relations with Moscow.

Hunter Biden's business partner, Devon Archer, had joined the board a month earlier when the UK froze Burisma's bank account holding $23 million, following suspicions of money laundering.

Back then, Joe Biden was vice president and President Barack Obama's point man for Ukraine, a country facing Russian and Russian-backed forces in the Moscow-instigated war in Ukraine's eastern Donbas region. The war there started after Yanukovych left the country. Russia had also taken control of the Ukrainian Peninsula of Crimea.

Burisma's owner, Mykola Zlochevskiy, former Minister of Ecology and Natural Resources, was under investigation for corruption and accused of using his position to profit from gas fields.

Hunter Biden had no experience in the energy industry, prompting speculation that he was hired to provide political cover for Burisman and the company's owner. The United States and allies were in the process of sanctioning former Yanukovych Government officials who were believed to have enriched themselves.

Hunter Biden was paid up to $50,000 a month, a high salary by US pay standards. The board members of Apple and Meta – the two largest companies in the world – were then paid an average of $30,000 per month. Biden has said he never talked to his son about his work, including Burisman.

"Such actions give Russia and other authoritarian regimes additional opportunities for propaganda. This is especially harmful in the context of the war, when Russia is actively trying to discredit Western democracies and their values."

Hunter Biden is expected to be sentenced on December 12 for two separate cases. In June, he was found guilty of lying about his drug addiction while filling out a government form in order to be allowed to own a firearm. Then, in September, he pleaded guilty to falsifying tax returns and late payment of taxes.

While he faced more than a decade in prison as a first-time nonviolent felon, he likely would have served several years in prison and could have avoided prison time altogether, according to legal experts.

As he announced the pardon, Biden accused Republican opponents of targeting him and his son and said he was worried that would continue after Trump takes office.

"No reasonable person, looking at the facts in the cases against Hunter, could come to any conclusion other than that Hunter was targeted solely because he was my son," Biden said in a statement to the media.

It is unclear whether the new Trump administration will investigate Burisman. Last year, Trump said he would appoint a special counsel to investigate the Biden family, although he did not elaborate on the potential charges that would be investigated.

The presidential pardon does not stop the Trump administration from initiating an investigation, but Hunter Biden could ask a court to dismiss any potential charges, citing the broad pardon he received, experts said./ REL
