Even though the USA and the European Union criticized the socialists for protecting the mandate of Olta Xhaçka by not taking it to the Constitutional Court, the head of the SP group, Niko Peleshi, has stated that the majority is uncertain about the issue.

After the meeting of the group, Peleshi told the media that the motion does not advance because of the voting, where some abstained and some voted against.

Peleshi stated that they will wait for the advice of the Venice Commission.

Peleshi: It is not a question of opposing the decision of the Constitutional Court because we respected the introduction in the first plenary session. It is true that this motion cannot progress due to voting some in favor, some against and some abstaining. The key word that defines the situation, ambiguity. Which right prevails, that is the ambiguity. I appreciate it as the right and wise decision to take it to the Venice Commission. It will be valid for all the decisions of the Constitutional Court that go through the decision in the session.

We have treated the decision of the Constitutional Court with the seriousness it deserves. The Assembly is a community of deputies and leads through voting in the session. In this case there was no political decision and no group decision. We have not had clarity. When there is ambiguity, the form of abstention should be treated as ambiguity. We will implement what the Venice Commission advises us. It does not oblige us, but we will implement it. It is not about the name of a deputy, the parliamentary group would not lose its weight, this is not a political action.

On the one hand, we have the right to vote as a deputy, on the other hand, we have a decision of the Constitutional Court. I voted abstention because I belong to that group of deputies who are unclear about who prevails, the free will of the deputies or the Constitutional Court. Both are based on the Constitution. We will implement the advice of the Venice Commission.
