The Ministry of Education has prepared a draft with legal changes for the pre-university education system, based on the numerous reported cases of violence, abuse of teachers and students.
The prepared draft foresees provisions that prohibit the inclusion in the educational system of persons who have been convicted of criminal offenses related to minors, or pre-university educational institutions, regardless of their rehabilitation.
This has been confirmed by the Minister of Education Evis Kushi through the posting of the signed order that foresees the legal changes. The draft proposed by the Ministry of Education foresees a 3-month trial period and psycho-social assessment for new teachers and all employees of pre-university educational institutions.
"This instruction is in full compliance with the Labor Code, which in Article 142, Point 1 provides for the first 3 months of work as a trial period. According to point 2, this time can be removed or reduced by the collective labor contract, but the collective contract in force does not have any definition regarding the time of the trial period, leaving the implementation directly to the Labor Code and by-laws in force . Based on the cases found over the years of teachers who have committed violence, abuse or other criminal offenses against students, throughout this school year we have undertaken a series of legal and by-law initiatives to avoid the danger that may come to our students from persons who do not guarantee high moral, professional and legal integrity.
In the new draft amending the law on the pre-university education system, which is in public consultation and will be reviewed soon in the Parliament of Albania, we have provided provisions that prohibit the inclusion in the education system of persons who have been convicted of criminal offenses related to with minors, or pre-university educational institutions, regardless of their rehabilitation.

Ky udhëzim është në përputhje të plotë me Kodin e Punës, i cili në Nenin 142, Pika 1 parashikon si kohë prove 3 muajt e parë të punës. Sipas pikës 2, kjo kohë mund të hiqet apo reduktohet me kontratën kolektive të punës, por kontrata kolektive në fuqi nuk ka asnjë përcaktim lidhur me kohën e periudhës së provës, duke ia lënë zbatimin drejtpërdrejt Kodit të Punës dhe akteve nënligjore në fuqi.
Periudha e provës është aplikuar nga strukturat tona arsimore në të gjitha periudhat. Madje në Udhëzimin e mëparshëm Nr. 38, datë 6.10.2015, Pika 4 e Kreut 4 parashikonte që kandidati emërohet me kontratë 1-vjecare (periudhë prove) dhe Pika 5 parashikonte që në përfundim të këtij afati parashikohet edhe vlerësimi psiko-social.
