"The river became the owner", the residents of Imshta in Lushnja: State property. Buyer: I bought it with state documents!

"The river became the owner", the residents of Imshta in Lushnja:

Residents of the village of Imshte in Lushnje are protesting that hundreds of hectares by the river Seman have been sold to them.

According to them, the property is inside the embankment and the laws foresee it as "state property". However, an individual went to them with cadastral papers to surround and develop it. The new owner, Elton Çekrezi, said he bought it with the state's own documents. So, on the one hand, the state determines that the land between two embankments is state property, and on the other hand, it certifies and returns such property to an owner!

"This land used to be the village, now they are taking it from us. These lands are inside the embankment that was built in the 60s. The law stipulates that the land within these embankments is state land. We don't understand how the owner got away with it. Dozens of owners who claim it have come here. We drove some of them away. We did not divide this land with Law 7501. It was forest and river land. Here in winter the river comes out and floods it. We built the embankments and now it doesn't come out anymore. In the summer we each work a part and plant it. Now they came here with the police, enforcement and property. We don't even know them. I don't know how they made the cards. These register hundreds of hectares for themselves. As a village, we have not registered our properties. How did they make the papers, when it is river land, by the river? Why don't they make us letters?" residents claim.

Other residents add that the police and enforcement came a few days ago. "They wanted to surround him, but why are they surrounding him? The river and the embankment that was built" they say. According to them, the legislator (Erion Braçe), who had an exchange of letters with the Property Handling Agency, is also interested in this problem. The ATP itself says that "according to the web-gis verification, according to the layout map, there is no property there". "Now when the ATP says I didn't treat it, how did these come? How did they register it in the Cadastre? We demand that the origin of this property, how it was obtained, be investigated. That until now the police have only dealt with us, they have accompanied us and proceeded to say that we are protecting the state's land. We don't claim that property, that's why we didn't divide it in 1991. River land and we left it like that. But not to take it from us" they conclude.

Law number 111 of 2012 on "integrated management of water resources" defines that "the space of land up to the embankment is the property of the state and is inalienable and indescribable". "They are owned by the state and under the administration of state bodies - All riverbeds ... The land benefited from the withdrawal of water or from the advance of the land in the direction of the water when it is connected to the land. All hydrotechnical structures and works carried out by the state such as dams, irrigation, drainage, navigation systems". In the meantime, the VKM has also been issued for implementation, which stipulates that the lands between the two embankments are state-owned.

Fiksi also talked with Mr. Elton Çekrezi, who says he bought the land. According to him, there have been several trials for the release of the land and that it belongs to the Xindoli family. To the question that it is within two embankments, he tells us that the embankment was built in the 60s and that the family obtained the land in 1999 with a decision and return of compensation. He asked in Lushnje and was told that it is land without problems. In relation to the ATP document, it says that the request was made for web gisin and that the file was there. "If it was given illegally, why is there a mortgage?" he asks.

So, the same property where the owner and the buyer have received a certificate from KADASTRA and on the other hand the ATP and the law prohibiting it from being privatized. The fact is that hundreds of residents are in conflict with owners and buyers for this property, where the only ones who are not investigated are the state officials who have certified it. top channel
