Salianj and Murriz sued for defamation, GJKKO rejects the request of the former

GJKKO dismissed the request of Fredi Kokonesh, the former mayor of Divjaka, for defamation against Ervin Salianji and Myslym Murriz.

1. The injured accuser Fredi Konkoneshi, on 04.04.2024, submitted to this Court the request for the trial of the criminal case with the object: "The initiation of criminal proceedings against the Democratic Party, for Mr. Myslim Murrizi, Mr. Ervin Salianji, the guilty declaration for committing the criminal offense of "Defamation", provided for by Article 120 of the Penal Code.

2. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime with a panel composed of judge Rudina Palloj, based on articles 112, 328 point 1, letters ç) and f) and 59 of the Code of Criminal Procedure, as well as in articles 66, letter dh) and 120 of the Criminal Code, with decision no. 50, dated 10.09.2024 decided:

1. Dismissal of the criminal case with no. 70, registration date 04.04.2024, with parties:

Injured accuser: Citizen Fredi Kokoneshi;

Accused: Citizen Myslym Murizi and citizen Ervin Salianji;

Accused of committing the criminal offense "Defamation", provided by Article 120 of the Criminal Code, as the prosecution was carried out beyond the limitation period, according to the provisions of Article 66, letter dh) of the Criminal Code, and for this reason, in reference in article 328, point 1, letter f) of the Penal Code, cannot continue.

2. Court costs remain as incurred.

3. An appeal can be made against the decision to the Special Court of Appeal for Corruption and Organized Crime, within 15 (fifteen) days from the day after the communication of the reasoned decision.
