The special subcommittee on Laws cast the third lot on Tuesday from which the names of the new members from the ranks of lawyers who will sit in the High Judicial Council and the High Prosecution Council emerged.

The candidates Bledar Bajri and Albens Tabaku for the High Judicial Council and Erind Merkuri and Erind Gërmenji for the High Prosecution Council were chosen by lot.

All four candidates come from careers in the legal profession and as jurisprudence lecturers. Meanwhile, Merkuri also worked as a legal expert of the Assembly and a legal representative of this institution in the Constitutional Court in the battle of the SP to dismiss the former president Ilir Meta and to protect the mandate of deputy Olta Xhaçka.

According to the legal provisions, this list with the four names of the candidates will be formally voted on in the plenary session, since the first two lists from the lottery failed to receive 2/3 of the votes of the deputies.

The election by lot is a solution provided by law when consensus fails between the members of the majority and the opposition in the subcommittee on the names that will go to the plenary session.

The process of selecting new members from the ranks of the legal profession was accompanied by political debates, as the opposition contested the report of the General Secretary of the Assembly, Genc Gjonçaj, who disqualified several candidates from the initial list approved by the independent commission for not meeting the legal criteria. of verification filed with the People's Advocate.

The process of selecting new members in the two high councils of the justice system envisages choosing 2 new members, one for each council, from among civil society.

On Tuesday, the subcommittee also discussed the Secretary General's report on this list.

Gjonçaj has qualified only two names for the 2 vacant positions out of 6 candidates who have passed the preliminary assessment, so that there are two candidates for the KLJ, Erjon Fejzulla and Violanda Theodhori, while only Fejzulla is in the running for the KLP.

The head of the DP parliamentary group, Gazment Bardhi, called the reasons for the disqualification of the candidates illegal and absurd.

"The absurdity goes as far as making it impossible to apply the constitutional procedure, which is the casting of lots, leaving one candidate in the race" - said Bardhi, calling it illegal the disqualification of candidates who had won court decisions to be included in the race.

But Gjonçaj, as in the previous hearings, insisted that he had only implemented the constitutional provisions to bring to the Assembly a list of names that met the legal criteria.

"This is not a process to find jobs for some people, but to find the right person for the job" - he said, clarifying how he understood the process of legal verification of criteria.

After the debates, the members of the subcommittee did not find an agreement to add the names disqualified by Gjonçaj to the final list, continuing the process with only two candidates for two vacancies, which is expected to end in an impossible process of drawing lots.

The filling of the vacancies in the two councils is 6 months late, as the mandate of the 6 members of the councils who are expected to be replaced from the list of lawyers and civil society ended in December. Reporter.al
