The Venice Commission has prepared the preliminary draft for the validity of the local elections of June 30, 2019 that were held in Albania.
It was the Constitutional Court that in June decided to turn to the Venice Commission for an opinion. The lawsuit in "Constitutional" was filed by the Association of Municipalities, led by the mayor of Shkodra, Voltana Ademi. The association demanded that the 2019 elections be declared invalid.
The Venice Commission will meet on Friday and Saturday, where it will approve and publish the report, but details for the Albanian media have emerged from the preliminary draft.
"Venice" articulates that the President of the Republic has no right to postpone the elections in the absence of a legal basis. It also considers that the Constitutional Court has no jurisdiction to review the invalidity of elections.
The Venice Commission says that the parties are not obliged to participate in the elections, but considers the boycott unacceptable. Recall that the DP did not participate in the 2019 local elections.
The draft was prepared through the expertise coordination mechanism within the joint EU / CoE program, according to the agenda of the Venice Commission.
