The Special Appeal Board decided today to dismiss the head of the High Council of Prosecutors , Alfred Balla.

According to the decision, for the next 15 years, Balla will not be able to run for prosecutor or judge or for other positions in the justice system.

The decision of the special appeals panel overturned the decision of the KPK, against which the public commissioner appealed. 

How Alfred Balla 'saved' himself from veting

The head of the KLP, Alfred Balla was subject to vetting according to the legislation in force due to his work as a legal assistant in the Supreme Court until July 31, 2017 and had to undergo the re-evaluation process.

However, two of the members in the majority, chairperson Xhensila Pine and rapporteur Alma Faskaj, assessed that Balla was no longer subject to re-evaluation and that his process should be closed without a final decision. Pine and Faskaj reasoned that Balla had not resigned and that he had lost his status because he was dismissed by the head of the Supreme Court in July 2017.

In the minority, commissioner Valbona Sanxhaktari presented a parallel opinion. She assessed as important the legal status in which the subject was found at the time of entry into force of the constitutional amendments and the law on the vetting of magistrates, as well as the will or attitude of Balla in relation to the progress of the re-evaluation process. According to her, Balla should either undergo the transitory re-evaluation process, or should be subjected to the provisions of Article "G" of the annex of the constitution, which determine the termination of vetting with a 15-year sanction.

In June 2023, the Public Commissioner, Florian Ballhysa appealed the decision of the Independent Qualification Commission, KPK to end the vetting without a final decision and without sanction against the current head of the High Council of Prosecution, Alfred Balla.

Ballhysa described the decision-making of the majority of the Independent Qualification Commission as contrary to the constitutional provisions and requested the change, where, in addition to the termination of the vetting, he requested that Balla be also sanctioned, prohibiting him from being appointed to some positions in the justice system for 15 years. including the function he currently holds.

Arguments of appeal

Commissioner Ballhysa called the decision-making of the majority of the Commission unfounded in the factual situation. He brought to attention the purpose defined in the Constitution for the vetting process, that of the functioning of the rule of law, the independence of the justice system and the restoration of public trust in justice. Also, his reasoning was based on the jurisdiction of the College and the findings of the international observer presented to the KPK in June 2022.

Gjykata ka vendosur gjithashtu se Balla e ka humbur statusin e këshilltarit ligjor vetëm kur u zgjodh si anëtar i KLP-së në vitin 2018, si dhe i është dhënë e drejta të përfitojë pagesën si këshilltar ligjor deri në atë moment.

“Në një situatë ku z. Balla nuk do ishte liruar (jo ligjërisht) nga detyra e tij, ai do ushtronte shërbimin në sistemin e drejtësisë. Fillimisht, në Gjykatën e lartë (si Këshilltar ligjor jo magjistrat) dhe më pas në Këshillin e Lartë të Prokurorisë si magjistrat. Por në të dyja rastet, ai do mbante statusin si subjekt rivlerësimi dhe do ishte nënshtruar procesit të rivlerësimit”, pasqyrohet në ankim mendimi i ONM.

Bazuar në opininion e ONM-së, trupa e KPK-së ka vazhduar procedurën e vetingut për Ballën duke e konsideruar subjekt rivlerësimi, si dhe ka i dërguar atij dy pyetësorë në drejtim të vlerësimit të pasurisë, procedurë e cila ka zgjatur deri më datë 30 maj të vitit 2023, kur Komisioni i ka dërguar subjektit rezultatet e hetimit, duke konkluduar me përfundimin e procesit të rivlerësimit pa vendim përfundimtar.

Referuar akteve në fashikullin e Komisionit, Ballhysa vlerëson se që prej momentit kur vëzhguesi ndërkombëtar ka paraqitur mendimin e tij dhe kur trupa e KPK ka vendosur ta vijojë procesin, e deri në paraqitjen e rezultateve të hetimit afro një vit më vonë, nuk ka ndryshuar ndonjë rrethanë që të mund të dilej me një përfundim të ndryshëm, duke konstatuar se Balla nuk e gëzonte më cilësinë e subjektit të rivlerësimit.

Ai shton se sipas praktikës së konsoliduar të Kolegjit, në momentin kur fillonte procedura e rivlerësimit, jo domosdoshmërisht subjektet e rivlerësimit mbanin të njëjtën detyrë funksionale për të cilën ex officio, Kushtetuta dhe ligji i kishte parashikuar si të tillë.

Komisioneri Publik vlerëson se Alfred Balla e ka fituar statusin ligjor të subjektit të rivlerësimit, që në momentin e hyrjes në fuqi të ndryshimeve Kushtetuese e, për pasojë, do të duhej t'i nënshtrohej ex officio procesit të rivlerësimit kalimtar, në zbatim të kuadrit ligjor në fuqi, i cili rregullon këtë proces.

"The reasoning of the Commission that the subject of the revaluation, Mr. Alfred Balla: ... has lost the status of the subject of revaluation, not as a result of the end of the revaluation process, or of his resignation, but as a result of an act that decided to terminate his employment relationship, contradicts the Constitution and the law and it doesn't even match the content of the acts in the dossier, " Ballhysa reasons and adds that when the subjects decide not to undergo the vetting process, then they are excluded from the possibility of being appointed to some of the judicial bodies for a period of 15 years.

Ballhysa also brings to the attention of the College the fact that Balla, while on the one hand demanding the termination of the revaluation process, on the other hand has made the order of the President of the Supreme Court for the release from office the object of judgment, turning to the judicial jurisdiction in 2020 where among other things, it has been stated that he had waited for the Supreme Judicial Council to be created and to review the acts exceeding the powers of the former President of the Supreme Court.

"...The subject of the reassessment has addressed a written request to the Supreme Judicial Council, asking it to recognize/have the status of a legal advisor at the Supreme Court," notes Ballhysa and clarifies that the KLJ in 2020 suspended the review of the request with the argument that this case was being handled in court.

The complaint also reflects the fact that, when the KPK team continued to send questionnaires, in February 2023, Balla filed a request with the Administrative Court of Appeal for a complete waiver of the right to sue, as he thought that the current status at the High Prosecution Council does not match that of the legal assistant that he enjoyed until 2017.

Subsequently, Balla addressed the Supreme Court with a request to waive the previous request for the declaration of having the status of a non-magistrate legal advisor in the Supreme Court, reasoning that the trial had ended at both levels and that the current position in KLP does not agree with the status of legal assistant.

The HCJ decided in May 2023 to cancel the suspension of the review of the request and the termination without a final decision of its review, due to Balla's resignation.
