The SPAK decision to punish journalists, even one of them, who extract parts from the depositions of the penitent of justice Dumani, is as unconstitutional as it is strange.

Raporti zbulonte para publikut përfshirjen politike e ushtarake 30 vjeçare, nga 1945 deri 1967, të SHBA dhe të administratave që nga Truman, Eisenhower deri Nixon, përfshirë Kennedy e Johnson. Madje konkludimi për këtë të fundit ishte se “gënjeu sistematikisht, jo vetëm publikun, por dhe kongresin” për mundësinë e fitores së kësaj lufte të konsideruar të humbur në raport, pavarësisht se mijëra amerikanë dërgoheshin ende në front.
Botimi shkaktoi një valë të gjërë protestash të forta kundër luftës dhe debati politik.
Ishte Daniel Ellsberg, hartues i raportit bashkë me mikun e tij Anthoni Russo që e fotokopjuan atë dhe ia dorëzuan gazetarit Neil Sheehan të New York Times.
Pas botimit dhe alarmit të shkaktuar dhe pasi kërkuan nga gazeta mosbotimin vullnetar, gjë që u refuzua, Nixon dhe prokurori i përgjithshëm John Mitchell nxorrën një urdhër të gjykatës federale që detyronte NYT, të ndëpresë botimin. Botuesi i NYT Arthur Ochs Sulzberg refuzoi, duke theksuar se “ato janë pjesë e rëndësishme e historisë që duhej të ishin nxjerrë më parë dhe që nuk shkelin sigurinë kombëtare”.
Në solidaritet me NYT, më 18 qershor, reporteri Ben Bagdikian dhe redaktori Ben Bradlee të Washington Post, filluan botimin e pjesëve të tjera të servirura po nga Ellsberg.
Kur ndihmës prokurori i përgjithshëm i SHBA Rehnquist, kërkoi urdhër-ndalimi botimi për Washington Post, gjykatësi Murray Gurfein nuk pranoi, duke argumentuar se: “Siguria po ashtu qëndron në vlerën e institucioneve tona të lira”.
Qeveria amerikane e apeloi vendimin duke riakuzuar gazetat NYT dhe WP, e gazetarët e tyre dhe më 26 qershor Gjykata Supreme pranoi shqyrtimin.
Në 30 qershor (koincidencë e zezë për Ramën) Gjykata Supreme dha vendimin 6 me 3 në favor të New York Times dhe Washington Post, duke rrëzuar qeverinë amerikane në pretendimin e saj për nxjerrje të sekretit shtetëror.
Shtypi i lirë triumfoi kështu ndaj “sekreteve” qeveritare.
Argumenti bindës i trupës prej 9 anëtarësh ishte Amendamenti i parë i Kushtetutës amerikane. Ky Amendament garanton lirinë e mendimit, të fjalës, fesë.
Në një paragraf të vendimit shkruhej:
“Vetëm një shtyp i lirë dhe i pakufizuar mund të paraqesë në mënyrë efektive mashtrimet e një qeverie”
Njëkohësisht dhe Ellsberg e Russo u çliruan nga akuzat për spiunazh dhe nxjerrje sekreti.
Ngjashmëria e kësaj ngjarje me situatën e botimit të dëshmive të Dumanit është e prekshme
Për më tepër “sekreti” i Dumanit krahasuar me sekretin e Vietnamit është fare, fare krejt banal, sepse publikimet nuk cënojnë asnjë lloj sigurie kombëtare.
Cënojnë zyrtarët qeveritarë të Ramës, po.
