Providing online services, report: Institutions, delays in update requests

Public institutions that offer their services online on the centralized platform for which the National Information Society Agency is responsible have in some cases been late in submitting legal changes that should be reflected in the relevant electronic forms.

The Supreme State Audit Office, in its latest report published this April on the implementation of recommendations made for online services, underlines that the update should be seen as a priority, monitored with periodic reports. According to the Supreme State Audit Office, this would avoid delays and consequently not penalize businesses and individuals.

 "Regarding the written correspondence of state institutions with the National Agency for the Information Society, the following were found: - Failure to comply with legal deadlines in time regarding the obligation that state institutions have to introduce legal changes that must be reflected in the electronic form by the National Agency for the Information Society, so that citizens and businesses are not penalized," the report states. 

Specifically, according to the SAI, those that have had delays are: – The General Directorate of Road Transport Services has sent the electronic format for the approval of the new road vehicle circulation permit with about 2 years delay from the issuance of Order No. 284, dated 07.10.2020 "On the approval of the new road vehicle circulation permit";

 – The General Maritime Directorate has forwarded the letter with no. 7997.prot., dated 21.12.2022, in implementation of Instruction no. 16, dated 20.07.2022 of the Minister of Infrastructure and Energy “On updating the service related to the application for registration and provision of a maritime passport and the application for registration and provision of a maritime passport for Albanian, foreign, stateless citizens” about 6 months late; –

 Ministry of Infrastructure and Energy in implementation of the order of the Minister of Infrastructure and Energy no. 61, dated 05.06.2012, revised by orders no. 432/1, dated 17.02.2017 and no. 392, dated 29.12.2020, which requested the implementation of two services:

Application for qualification as a pilot candidate, Application for registration and issuance of a pilot certificate; Has sent to the National Agency for the Information Society, letter no. 5479.prot., dated 06.09.2022, about 1 and a half years late, in non-compliance with legal deadlines.

"Regarding the above, the National Information Society Agency did not find any measures taken regarding the delays of institutions in submitting requests with the relevant changes and updates to the information and the published electronic form," the SAI underlined. 

In this context, the report recommended that the National Information Society Agency, in cooperation with the Agency for Dialogue and Co-Governance, draft periodic monitoring reports on state institutions' compliance with deadlines to enable the updating of electronic forms according to changes in the respective legislation./Monitor
