"Investigate Olta Xhaçka and her husband for 3 charges", GJKKO

The Special Court has accepted the complaint of MEP Fredi Beleri against SP MP Olta Xhaçka and her husband Artan Gaçi.

As a result, the GJKKO has ordered SPAK to register a criminal complaint and initiate investigations against them, on charges of abuse of office, forgery of documents and laundering of the proceeds of a criminal offense committed in collaboration.

Beleri requested that the decision of December 27, 2024, be reviewed and that investigations be opened against them. 

" The court finds that the complaint filed by citizen Alfred Beleri against citizens Artan Gaçi, for the commission of the criminal offense 'Forgery of documents' and 'Laundering of proceeds of crime' committed in collaboration as provided for by articles 186 and 287 of the Criminal Code, and Olta Xhaçka, currently Minister of Foreign Affairs, MP, for the commission of the criminal offense 'Abuse of office' as provided for by article 248 of the Criminal Code, does not have a decision-making basis, and that the appeal filed by citizen Dhionisis Alfred Beleri, for this part of the complaint, is based on the law.

In this specific case, the Special Prosecution Office should register criminal proceedings and continue the investigations, on the allegations in the complaint registered with no. 81/2023 that the former Mayor of Himara, Jorgo Goro, the Vlora District Council and former employees of the Vlora ZVRPP, in cooperation with each other, have committed acts related to the falsification of official documents, which were used to register an immovable property owned by the entity Foto Mëhilli, and this property was alienated in favor of third parties, specifically the family members of the complainant Olta Xhaçka, who at the time of these decisions by the Council of Ministers, exercised the state duty of Minister of Defense at that time, and the political function of MP.

"Citizen Olta Xhaçka, through her inactions, by not declaring the conflict of interest, has benefited through the marital regime, property rights and illegal benefits, which according to the law on strategic investors and the law on conflict of interest, do not belong to her. This citizen, through strategic investment in a falsified property, has benefited from the right to free use of state assets for which ordinary citizens pay tax obligations, etc. ," the decision states, among other things.
