DP: Why does the Albanian state deny citizens the ownership that belongs to

The Anti-Corruption Spokesperson for the Democratic Party, Genta Vangjeli, has raised accusations against the Albanian state and entrepreneur Ergest Krakulli.

Vangjeli emphasized that the Sylari family, owners of the land in cadastral zone 8571, had the right to receive an area of 67.1 m², as defined in a 2007 agreement.

However, she claims that the state, through the State Cadastre Agency and other bodies, has failed to execute a final decision by the Vlora Court of Appeal, thus denying the owners' rights.

Full statement:

In 2007, the Sylari family, in their capacity as the owner of the land, entered into a deed of agreement with the entrepreneur Ergest Krakulli, etc., for the construction of a building in which the owners of the land would benefit from residential premises totaling 810 m2 on property no. 18/199, cadastral zone 8571, Kongresi neighborhood, Lushnje city.

In violation of this deed of agreement, the owners of the land were denied the right of ownership for the area of 67.1 m2.

For this, they sued the entrepreneur in court and the Lushnje Judicial District Court, by decision no. 362 dated June 5, 2017, decided to fully accept the claim and oblige the entrepreneur Ergest Krakulli etc. to hand over 67.1 m2 to the plaintiffs.

The Vlora Court of Appeal has given final form to this judgment, leaving this right of the plaintiffs in force through its decision no. 251 dated October 26, 2022.

Although the court found the entrepreneur's actions illegal by denying the 67.1 m2 area that belongs to the owners of the land according to the deed of agreement, the latter testified that they were unable to execute the decision to recognize ownership even for these denied square meters.

State bodies, specifically the State Cadastre Agency, the Central Real Estate Registration Office, are aware of this injustice.

But what forces the Albanian state to deny citizens the ownership that belongs to them when they have a final court decision to this effect?

Why does the state itself break the law with both feet?

Does this happen in this specific case given that entrepreneur Ergest Krakulli was supported by Taulant Balla and maintained the status of leader of the SP in Lushnja?

The Democratic Party strongly condemns this injustice and appeals to the relevant bodies to recognize the denied ownership of legitimate owners who have been struggling in the courts for years to prove their rights, and as a result, the state itself denies them this right.

We assure Albanians that these will end on May 12th.

Together, let's return Albania to the Albanians...
