The Prosecutor's Office at the Court of First Instance of General Jurisdiction in Tirana has registered a criminal proceeding for the criminal offense of "Disclosure of secret acts or data", provided for by Article 295/ai of the Criminal Code, following the publication in the media of film footage from the tragic event in which the minor Martin Cani lost his life.

According to the official announcement of the Prosecution, this is a video distributed on several portals and media, which contains footage dated November 18, 2024, where minors appear with names and identifying data next to each one. These footage, according to the prosecution, are part of the evidence administered in the investigation file and were used in the judicial process that is currently taking place behind closed doors at the Tirana Court.

The prosecution emphasizes that the images are the same as those contained on a CD administered as material evidence from security cameras in the area around the “Fan Noli” school, where the incident occurred. This CD was handed over to the victim’s family’s defense attorney only after he signed a non-publication statement.

The publication of the video constitutes a violation of Article 103 of the Code of Criminal Procedure, which prohibits the publication of evidence that is part of a closed-door trial, as well as a violation of the rights of minors who are involved as victims, defendants or witnesses.

The prosecution assesses that there is sufficient evidence to prove the commission of the criminal offense in question and has launched investigations to identify the persons responsible for the leak and publication of materials prohibited by law.
