SPAK closes the investigations and takes Plarent Ndreca to court

The Special Prosecutor's Office has closed the investigations for the socialist MP Plarent Ndreca and 16 other former officials of the Ministry of the Interior.

SPAK has taken the file of Ndreca and 16 others to court.

According to the investigations carried out by SPAK, "officials of the Ministry of the Interior, the Territorial Development Agency, the National Territorial Planning Agency and the National Inspectorate of Territorial Protection have deliberately collaborated to favor a merger of economic operators, violating the provisions of the law on public procurement" .

NOTICE:

The Special Prosecutor's Office Against Corruption and Organized Crime, on 25.11.2024, sent for trial criminal proceedings no. 240 of 2021 against 16 former officials of the Ministry of the Interior and other institutions, accused of serious violations during public procurement procedures in 2019.

Favoritism in procurement procedures

Investigations have revealed that officials of the Ministry of the Interior, the Territorial Development Agency, the National Territorial Planning Agency and the National Inspectorate of Territorial Protection have deliberately collaborated to favor a merger of economic operators, violating the provisions of the procurement law public.

The public procurement contract "Study and Design of some facilities of the State Prosecutor's Office" had a total value of ALL 54,234,000 (without VAT) for four police facilities, but in fact ended up including only two police facilities with a reduced value of ALL 34,248,000 , this is because the Ministry of the Interior did not have the full fund, but to favor the winner, it signed the contract for only two objects, as much as funds were available.

Documented violations

From the collected evidence, it results that a group of officials led ex officio by Plarent Ndreca, former Secretary General of the Ministry of the Interior, who has been the Head of the Contracting Authority, have committed legal violations in the stages of the tender to declare citizen Gjon the winner Radovani, despite the non-fulfillment of the legal criteria by the latter.

Members of the procurement unit such as Denisa Skënderaj, Lira Kolasi, and Blendi Kovi, together with members of the Bid Evaluation Commission, including Lindita Mukaj, Ferdinant Tarazhi, Silva Dauti, Grida Isufi, Deni Klosi, Jonarda Qurku have taken deliberate actions to divert legal procurement procedures. Also, the member of the Complaints Review Commission, Julia Hysa, and other involved officials such as Elora Kokalari and Aida Shehi, have contributed to the deviation of legal procedures.

A commission for the handover of the project, consisting of Emiliano Mehmeti, Klejdi Meço and Erand Rrobaçi, has signed false minutes to justify the handover of the project, while the final project was not realized.

From the illegal actions performed, a financial damage was caused to the state, estimated according to the contract in the amount of ALL 34,248,000. Until this moment, this amount has not been executed, although the beneficiary has issued the relevant invoices due to the opposition/audit of the General Directorate of the State Police on the illegalities identified during the process.
