Berish reads the EC report: This is the obituary of the rule of law! The justice

Democratic Party (DP) leader Sali Berisha read this Friday the EC Report on Albania on the fight against corruption. 

In a statement to the media, Berisha says that the report is a violation of the rule of law, which according to him has been replaced by a narco-state. 

Berisha raises accusations that the justice system is dominated by corporations, while adding that the opposition will present facts and documents for each paragraph of the report that, according to him, proves the failure of the fight against corruption and a series of other abuses of the current government.

Since fraud is a major platform, I have to present to Albanians some of the most essential findings of this report, which is dedicated to the functioning of the rule of law in Albania and specifically the justice system.
The inter-institutional coordination of the councils, namely the KLP, KLGJ and other justice institutions has not improved. It is therefore a disaster because they have no will to coordinate, but only to govern as separate corporations. And this is a disaster for the rule of law.

Major flaws found during the vetting show that in 56 percent of cases, judges were removed from office. Imagine what the Albanian justice system is left with. Out of hundreds and hundreds of judges and prosecutors, only 19 have been referred to the prosecution because most of them were removed without legal grounds, otherwise, according to the law and the Constitution, they should have gone before the law, before justice.

The defects previously identified in the appointments of non-magistrate members to the Supreme Court and the Supreme Administrative Court remain the same.
Parliament appointed three non-magistrate members to the Supreme Court and the Supreme Administrative Court, but the processes were delayed and heavily influenced by Parliament, which used numerous disqualifications, of course at the expense of the qualities and qualifications of the candidates.
The vetting of non-magistrates appointed by these is flawed and undermines transparency, meritocracy and the entire process.

Major challenges remain in the qualitative assessment, appointments, promotions and transfers of magistrates.
The Council, he says, has no regulations of activity.
Both councils do not adhere to the times and deadlines. They have accumulated a large number of files.
The Supreme Court of Justice does not have internal regulations for effective functioning, while the KLP should be reviewed.
In both councils, listen, regulations on conflict of interest procedures for their members are missing, which brings potential conflicts of interest - they do not ask - and the conflict of interest is not addressed.
The High Inspector of Justice has numerous vacancies, does not fill the positions, does not deal with the work. There are 1360 complaints, but they all molder in his offices.

The High Council of Justice accepted only two complaints for review. Imagine, there are hundreds, thousands.
The rule of impartial distribution of files is not applied. No!
Serious interventions are made by politicians in the system.

Access to justice has been limited, it says, especially in the court of appeal. So, there is no integrated justice system. More or less this is the essence of what is written.

But when it does not exist, they are corporations, which is why I started my speech with the word corporation. These people have not used the term corporation, but de facto when the system is not integrated, we are dealing with separate corporations.
Those who leave the vetting go to the head of the mafia in the judiciary, Arben Rakipi at the School of Magistrates. Of course, the name is not Arben, but the School of Magistrates.
Now let me stop here, it is so long, it is confusing, so I call on citizens not to fall victim to government fraud and government media.

Massive corruption is denounced, the failure in the fight against corruption, a number is given where it says 107 people were convicted and this number is three times lower than the number convicted in 2007 or 2008 for corruption.
So, to summarize, the report on the state of the rule of law in Albania is de facto a kind of obituary of the rule of law.
And I guarantee that we will present facts and documents for every paragraph of this report, both to its authors in the European Commission, as well as to our partners in Europe and the world.
