The Special Prosecutor's Office against Corruption and Organized Crime conducted investigations in the framework of criminal proceedings no. 13 of 2023 and at the end of them on 24.07.2023 it was addressed to the Special Court of First Instance for Corruption and Organized Crime with a request to send the case for trial in charge of the defendants:

Luan Çiçi, accused of the criminal offense "Passive corruption of persons exercising public functions" carried out in cooperation provided by article 259/2 and 25 of the Criminal Code.
Armando Luka, accused of the criminal offense "Passive corruption of persons exercising public functions" committed in cooperation provided by article 259/2 and 25 of the Criminal Code.
Besiana Xhelilaj (Gega), accused of the criminal offense "Abuse of duty" provided by Article 248 of the Criminal Code.
This amount of money was obtained in an irregular manner with the aim of not reporting and taking administrative measures for the violations found during the inspection in the subject Andi Selxhaferi PF. After the inspection, the defendants Luan Çiçi and Armando Luka on 27.12.2022 closed the inspection procedure cleanly without violations, without administrative measures and for this they received bribes in two cases from the citizen Andi Selxhaferi in the total amount of 60,000 ALL.


The defendant Besiana Xhelilaj, acting head of the inspection sector at AKBPM, after being informed about a case of trading a medication (hepatect) with a stamp different from the one issued by AKBPM, at a higher selling price, in violation of article 20 and 37 of the law 105/2014 "On drugs and pharmaceutical service" has not performed her functional duty. Violations of Article 20 and 37 of Law 105/2014 are punishable by administrative measures, but the defendant, even though she was aware of the illegal fact, did not ask for measures to be taken to identify and inspect the entity that sold it and the pharmaceutical warehouse, but sent messages to the representative of the warehouse that imports it, making it clear that administrative measures have been taken for other similar cases, implying that she is doing him a favor.

The investigations of this criminal proceeding were carried out by the investigators of the National Bureau of Investigation under the direction and control of the Special Prosecutor.
