The Special Prosecutor's Office and other institutions of justice have reported the work of 2023 to the Assembly of Albania.

Among them, the head of SPAK, Altin Dumani, reported to the deputies and answered their questions.

For about four hours, he was faced not only with their questions, but also with criticism and irony mainly from deputies Flamur Noka, Gazment Bardhi, Elda Hoti, Edi Paloka and Albana Vokshi.

"Crimes of corruption are intellectual crimes and therefore it is difficult for prosecutors to find evidence" , Dumani answered a question from the head of the DP group, Gazmend Bardhi. 

"It is an intellectual crime and the intellectual, before committing the crime, tries to hide it. Regarding the specific issue, the case is under preliminary investigation", Dumani said again.

Duman was faced with a flurry of questions from opposition MPs today, starting with the issue of incinerators, the 'Berisha' case and the use of two standards in the case of former Deputy Prime Minister Arben Ahmetaj, the mandate of Olta Xhaca, Xibraka, the Romanian agent Koldea associated with the Sinaloa cartel, etc.

However, the formula that Dumani chose to use during the reporting was to avoid with a dry expression 'I can't talk about this' and it was justified that it cannot interfere with the competences of special prosecutors.

Starting from Albana Vokshi, Tritan Shehu, Bujar Leskaj, Elda Hoti, Flamur Noka, they repeated the question "Why is Sali Berisha being held in custody?".

Describing Berisha as a political prisoner, some of the deputies did not spare the accusations towards Duman, saying that he violated the Constitution.

On the other hand, the head of SPAK avoided saying: 'I have no right to comment on the court's decision! The decision of the court has made the accusation clear' - said Dumani.

'To be associated with politics is out of the question. I am a prosecutor of the Republic of Albania trying to fulfill my legal and constitutional obligations.'' - said Dumani.

"Rama iu ka kërkuar të mbyllni Dosjen Xibraka"
Bardhi: Rezulton sipas informacioneve që disponon grupi parlamentar i PD-së se kryeministri Rama përmes një shtetasi një funksionar publik i ka përcjellë drejtuesit të SPAK juve duke kërkuar që çështja Xibraka të mbyllet sa më shpejt të jetë e mundur duke vlerësuar integritetin e drejtuesit të SPAK, duke mos ju kërkuar ta komentoni veprimin e kryeministrit dua ta dëgjoj prej jush përgjigjen që ju i keni përcjellë kryeministrit për këtë çështje. Pas kësaj ndërhyrje a jepni ju garanci që do kjo çështje do të hetohet në mënyrë të njëanshme.

Dumani:  Nuk mund të jap koment. Çështja është në hetim. Lidhur me marrëdhënien me kryeministrin apo çdo titullar institucioni qoftë edhe me Kuvendin, marrëdhëniet e mia janë vetëm institucionale dhe procedurale. Nuk marra dhe nuk përcjella asnjë lloj mesazhi ushtroj detyrën time në përputhej me dispozitat ligjore.

Pse po mbahen dy standarte për Berishën dhe Ahmetajn? 
Saimir Korreshi: Pse nga ana e SPAK është mbajtur dy standarde në lidhje me dy rastet e fundit,  rasti i Ahmetajt dhe zotit Berisha. Për Ahmetajn janë dërguar dokumentacionet lidhur me provat, 1400 faqe janë vënë në dispozicion të Këshillit të Mandateve dhe pastaj i është hequr imuniteti dhe marrja e masës së sigurimit. Ndërsa për Berishën është marrë masa e sigurimit dhe në komision nuk ka ardhur asnjë dokumentacion. A nuk duhet të mbajë standartizim SPAK për cështjen në fjalë?

Altin Dumani: Lidhur me pyetjen e parë, janë çështje në hetim paraprak dhe nuk mund të bëj asnjë koment dhe skam gjë për të ndarë me ju i nderuar deputet.

"Kush po hetohet për aferën e inceneratorëve?"
Flamur Noka: Ju po hetoni mega-aferën e inceneratorëve. Shqiptarët kanë parë se para drejtësisë janë disa specialistë të niveleve të larta. Për inceneratorin e Tiranës, a janë caktuar masa të reja? Kokat e aferave të gjithë i dinë, vetëm ju jo. A janë zbatuar masat dhe ku ka ceduar zbatimi i tyre? Operacioni i fundit u dekonspirua. A po hetoni? A po hetohet Erion Veliaj?

A ka hetime për familjarët e Veliajt? A jeni në dijeni të transfertave nga jashtë të 6 milionë euro, me emrin e vëllait të Veliajt? A mendoni se Veliaj si kryebashkiak dëmton hetimet për inceneratorët, 5D apo implikimin e vëllait të tij në afera? A po hetohen kompanitë në Qipro dhe shtete të tjera? Pse nuk sekuestrohet sera dhe toka në Sharrë, që kanë të bëjnë me inceneratorin e Tiranës? A po hetohet një kompani për shkelje kontrate për respiratorët? Solli 5 respiratorë dhe jo mbi 50, që duhet të sillte.

The investigation is complex. We want to do an objective investigation.

Who prevents you from arresting Veliaj?
Dumani : I mentioned that it is an intellectual crime, where I talked about the difficulties of investigating these corruption issues. This is a term used in criminology and I'm not the only one who uses it, it's called white collar crime. I was talking about the difficulties in the investigation. If a citizen commits a criminal offense he is under investigation. I was not talking about this investigation in particular, but about the difficulties faced by files involving intellectual crime.

Coldea case

Bardhi:  A scandal has been referred to in the media about an agent advisor of the Romanian secret services, Florian Coldea of ​​Prime Minister Rama, who is suspected of being involved in an international drug trafficking line between Albania, Mexico and Romania, has SPAK started an investigation?

Duman i: I don't have any comments, I don't talk about issues of this nature.

The microcredit scandal
"It is not a case not initiated by the Special Prosecutor's Office, the content also shows the history of the report. The Prosecutor's Office of Tirana initially handled it with a request for leave and turned to the court of Tirana with a request for leave. The Tirana court summoned us as a party and the SPAK prosecutor has not commented on the dismissal. We are not invested in a leave request.” Dumani said.

The issue of army properties/ Investigation for Xhačka and Begaj?
"There are things that could have been done better, we all have the opportunity to do better. When there are public statements, we do verifications. When a politician makes a statement, we investigate it rather than what someone says.
