The Constitutional Court overturned SPAK, ruling in favor of journalist Elton Qyno in his lawsuit regarding the decisions of the Special Court to seize electronic devices owned by him, search his home, and search his person following an investigation launched by SPAK to reveal investigative secrets.

The journalist himself, in a reaction made on Facebook, Qyno said that only Koçi Xoxe dealt with the arrests and persecution of journalists.

Qyno calls the pseudo-investigation launched against him by SPAK a farce, emphasizing that the Constitutional Court made a fair decision to protect the journalistic profession, protect sources, and protect freedom of reporting.

DECLARATION:

After 495 days of battle to protect the profession of Journalist and Journalistic sources, finally on April 22, 2025, eight judges of the Constitutional Court of the Republic of Albania, through a Unanimous decision (8 to 0), decided to certify the unconstitutionality of all actions taken by SPAK prosecutors, Judges and BKH officers who dealt with my file.

It was and continues to be a bad period for me that completely took my attention away from professional creativity, as all my focus was on the legal ordeal of court hearings, where I had to defend myself and my profession, against a party that was not easy to oppose.

The entire farce of the pseudo-investigation opened by SPAK on December 12, 2023, is now anti-constitutional and all actions taken by SPAK with the aim of revealing the sources of a journalist 20 years in the market are "Null" and Unusable.

For 495 days, SPAK is today unable to tell itself, Albanians, and internationals who is the person within their ranks who leaked the secret "SKY" materials.

An investigation that initially began as a whirlwind inside a "Teke ​​Rakije" and continued with the kidnapping and massacre of all the journalist's research work, ending with the statement that:

"...the journalist, while reporting on the crime, committed a crime...".

Apart from fair and professional reporting, I have not committed any other crime.

If it is considered a crime for a Chronicle journalist to give a critical opinion or bring to the public details and true facts from investigative files that SPAK or other prosecutors have in their custody, then we must accept that we live in the time of Koçi Xoxe and not in the time when freedom of expression and EU accession are trumpeted.

You tell us that we live in the era of Koçi Xoxe and I, but not even my colleagues, speak.

Only Koçi Xoxe has been involved in arrests and persecution of journalists (the arrest of Petro Marko, etc.). The SPAK seal cannot be used as a sniper to target critical voices and reporters.

The entire SPAK attack was initially focused on me and the only one who suffered in this story was me and my family. The result was a zero with a tail.

On the contrary, after 10 months they repeated the same story with checks and seizures, but this time placing me under investigation for "Passive corruption in the private sector", which was overturned by the Court of Appeals.

Today, I truly feel the need to thank from the bottom of my heart all the members of the Constitutional Court, who made a fair decision to protect the profession of journalism, protect sources, and protect freedom of reporting.

It is a victory for the entire community of journalists in Albania, and especially for the journalists of Kronika e Zezë and researchers. It is a decision ready for a journalism lesson.

I would like to thank my lawyers, Dorian Matlia of the "ResPublika" center, Arben Llangozi of the "Jurisprudence" studio, and the legal expert on international law Teo, who fanatically defended this issue at all levels of the Albanian judiciary and even the UN Human Rights Committee.

You were the best advisors to keep me calm.

I feel like thanking all those colleagues who never let me down, never discriminated against me, and publicly and everywhere defended my cause as if it were the same standard for themselves.
