The Special Court, through a decision signed on March 19, has allowed SPAK to examine all mobile phones and computer devices seized as part of the investigations being conducted against former Deputy Prime Minister and former Minister of Infrastructure, Belinda Balluku.

In accordance with a decision of the Constitutional Court, special prosecutors have approached the court to allow the dismantling of all equipment that was seized from persons under investigation, such as the former head of the Albanian Road Authority, Gentian Gjyli, and the former administrator of KESH Erald Elezi, but also from those in the know, among whom are several businessmen.

Previously, the dismantling of mobile phones was done without obtaining court approval, but based on the Constitutional Court's decision, a new practice was opened in which SPAK prosecutors are obliged to pass the court's filter in every case.

In this specific case, after receiving SPAK's request to allow the opening and access of the equipment, Judge Erjon Cela notified the parties and accepted the objections of the lawyers of the persons under investigation and knowledge, who through memos requested that the inspection of the equipment and the obtaining of data related to the investigative case against the former number two of the government be allowed.

Judge Erjon Çela, after reviewing the case, approved the seizure of all data, arguing that it is data of interest to the investigation. The data that will be extracted from phones or laptops will be analyzed in harmony with other data in the Balluku file. The former deputy prime minister is being investigated for pre-scheduling road tender procedures worth millions of euros.

During the examination of the phones of Ervis Berberi, the former head of the Albanian Road Authority, Balluku's confidant, messages were discovered that, according to SPAK, show that Balluku influenced the predetermination of the winning companies for the tender for the construction of the Llogara tunnel and all the lots of the Tirana Ring Road.

While Erjon Çela has given the green light to SPAK to investigate, the Constitutional Court's decision on Berber's case, which requires the inoperability of the data obtained from the surveillance of his mobile phones, is awaited with great interest.

The Constitutional Court's decision on this issue was postponed due to one of its members being absent. The next session is expected to take place on March 26 and will likely result in a decision regarding this issue, which directly affects the investigations into the Balluku file./ News24
