Behind the scenes of a war within the species / How the incinerator surveillance unit was paralyzed

Two months after the government signed the concession of the Tirana incinerator, Damian Gjiknuri ordered the establishment of the project implementation unit (NJZP), which would oversee the progress of the construction of the incinerator. The tender for the concession of the incinerator was developed by the Ministry of Environment, but two months after signing the contract, the government changed the contracting authority by appointing the Ministry of Infrastructure.

According to the order of Gjiknuri, number 178 dated November 6, 2017, the Project Implementation Unit consisted of 5 people. They were Miranda Lila, Artan Leskoviku and Ada Oseku as representatives of the Ministry of Infrastructure as well as Ilda Qazimllari and Ernis Toska as representatives of the Municipality of Tirana. But this order would prove to be short-lived, as only a month later it was changed again. In December 2017, through a new order, the first two members of NJZP were changed, Ms. Lila and Mr. Leskoviku, being replaced by two other names. These were Pëllumb Abeshi from the Ministry of Environment and Arben Kaçorri from the National Water and Sewerage Agency, this institution is dependent on MIE. The other three members remain the same.

Due to his experience, Mr. Abeshi is appointed as the head of the project implementation unit. NJZP functioned regularly until November 2020, when through an email Mr. Abeshi announced his resignation from the position of chairman and his departure from the Project Implementation Unit with the argument that he had started work as a lecturer at the Agricultural University of Kamza. From this moment, the paralysis of the unit that should supervise the progress of the incinerator construction begins.

According to the concession contract, NJZP had two key functions in supervising the implementation of the construction of the Tirana incinerator. She used the situation reports that the contract supervisor sent once every three months on the progress of the works and informed the Minister of Infrastructure and Energy in the capacity of the contracting authority about these situations through summarized memos. While the second function was that this unit could make physical inspections in Sawmill to see the progress of the works and their quality.

NJZP gets out of the game
One day after the announcement of Mr. Abeshi's resignation, the member of NJZP, Ada Oseku, who was a representative of the Ministry of Infrastructure, notified the Minister of Infrastructure Belinda Balluku and the General Secretary Viola Haxhiademi with an official letter about what had happened. asking the minister to take action.

"The chairman, Mr. Pëllumb Abeshi has left the institution he represents, making it impossible for the NJZP to meet and function. For the above, at the stage where the implementation of this contract is and the problems that emerged during its monitoring, we ask for your opinion on the replacement of Mr. Abeshi as well as the recomposition of NJZP with structural specialists in the field of waste and a lawyer" is stated in the letter dated November 11, 2020, that Mrs. Oseku sends to Minister Balluku and her secretary.

The chairman's resignation practically took the project implementation unit out of action and every report coming from the contract supervisor to the Ministry of Energy on the progress of the construction was reversed, as evidenced by this official letter of February 2021 from the general secretary of Belinda Balluku to the company Integrated Energy and the supervisor Ave Consulting.

"We inform you that due to the impossibility of decision-making as a result of the departure of the chairman of NJZP, representative of the Ministry of Tourism and Environment, and pending his replacement, the last quarterly report has not been considered. For this reason, we are returning the documentation, for the inclusion of these works in the next report," writes Mrs. Haxhiademi in the letter addressed to Integrated Energy and AVE Consulting.

During this time, the Ministry of Infrastructure asked the Ministry of Environment to send another member for appointment to NJZP, but Blendi Klosi no longer accepted. Although in December 2017, Mr. Klosi had sent Pëllumb Abeshi to NJZP, after the resignation of the latter, the Ministry of Environment refused to send another name with the argument that it was no longer the Contracting Authority in the concession of the incinerator, since the Contracting Authority had been transferred to the ministry of Infrastructure. Perhaps Mr. Klosi was beginning to feel that the incinerator was turning into a hot potato and he no longer wanted responsibility.

As the supervision unit was paralyzed, in May 2021, the supervisor sends the next quarterly report on the progress of the construction of the incinerator to the NJZP, so that the latter could inform Minister Balluku. But even this time, NJZP returns the report to the supervisor for the same reason. Ada Oseku again informs the general secretary of the Ministry of Infrastructure, this time asking her more directly to take measures.

Si anëtarë të NJZP-së kemi kërkuar nga Ministria e Infrastrukturës dhe Energjisë caktimin e kryetarit dhe riorganizimin e NJZP-së. Të ndodhur para faktit të mosfunksionimit me vetëm 4 anëtarë dhe mosorganizimit të mbledhjeve të NJZP, nuk mund të procedojmë me miratimin e raporteve të dërguara nga supervizori. Lutemi ndërhyrjen tuaj,” i drejtohet zonja Oseku sekretares së përgjithshme të ministrisë së Infrastrukturës.

Ngërç mbi ngërç
Ngërçi i NJZP praktikisht e kishte lënë shtetin pa sy në mbikqyrjen e kontratës së koncesionit të inceneratorit të Tiranës dhe për disa tremujorë rresht situacionet e raportuara nga supervizori ktheheshin mbrapsht pa miratim dhe vendimarrje nga NJZP. Ne qershor të vitit 2021, ndodh një tjetër zhvillim. Erion Veliaj njofton Belinda Ballukun se anëtarja e NJZP, Ilda Qazimllari do të zëvendësohej me Henrik Hysenbegasin.

Një javë pas kësaj shkrese, zonja Balluku merr vendim të emërojë pikërisht zotin Hysenbegasi nga Bashkia Tiranë si kryetar të NJZP. Këtu nis një ngërç edhe më i madh. Zoti Hysenbegasi nuk pranon postin e kryetarit të NJZP, me argumentin se ky post i takonte autoritetit Kontraktor që ishte Ministria e Infrastrukturës dhe jo Bashkisë së Tiranës.

Pas kësaj përlasje hyn në skenë edhe vetë Erion Veliaj. Përmes një shkresë drejtuar zonjës Balluku, Erjon Veliaj shkruan se Bashkia Tiranë nuk mund të mbajë postin e kryetarit të NJZP, pasi ky post i takon autoritetit kontraktor, dmth ministrisë së Infrastrukturës.

“Bazuar praktikave të mëparshme të ngritjes së NJZP-ve dhe meqënëse shumica e anëtarëve të NJZP i përket Autoritetit Kontraktor duhet që kryetari të jetë një nga anëtarët e Autoritetit Kontraktor, mundësisht nga drejtoria e Mbetjeve. Ju bëjmë me dije se zoti Hysenbegasi do të jetë anëtar i NJZP, por nuk mund të mbajë funksionin e kryetarit,” i shkruan Veliaj Ballukut në shkresën me datë 2 gusht 2021.

Përplasja shkresore për postin e kryetarit vazhdoi gjatë. Megjithatë pas qershorit 2021, NJZP tashmë e ngelur me katër veta, dy anëtarë të MIE dhe dy të Bashkisë Tiranë, filloi të shqyrtonte raportet e supervizorit, pasi kishte më shumë se dy tremujorë që i kishte kthyer mbrapsht ato. Në korrik të vitit 2021, u zhvillua mbledhja e radhës e NJZP, ku katër anëtarët firmosën shtyrjen e afatit të ndërtimit të inceneratorit me 2 vjet duke i kërkuar sërish ministrisë së Infrastrukturës t’i jepte zgjidhje çështjes së kryetarit.

Bie ligji i koncesioneve
Dhënia në seri i koncesioneve nga qeveria kishte filluar të krijonte shqetësim për qëndrueshmërinë e financave të vendit. Fondi Monetar Ndërkombëtar rriti presionin mbi qeverinë që kjo e fundit të mbikqyrte më hollësisht pasojat financiare të koncesionit. Si rezultat i presionit të FMN, qeveria u detyrua të ndryshonte ligjin e koncesioneve duke ngarkuar ministrin e Financave me detyrimin që çdo vit të paraqiste një raport vjetor të përmbledhur mbi ecurinë e kontratave aktive të konçesionit/ PPP, si aneks i raportit vjetor të zbatimit të buxhetit.

Raporti i publikua i plotë në vitet 2019 dhe 2020. Por në vitin 2021, raporti nuk mund të publikohej për shkak se inceneratori i Tiranës kishte mbetur pa mbikqyrje dhe ministria e Financave nuk kishte nga të merrte informacion për ecurinë e këtij koncesioni. Si rrjedhojë konflikti mes Belinda Ballukut dhe Erion Veliajt përplaset në ministri të Financave. Ngërçi konsistonte në faktin se kush duhet të raportonte në ministrinë e Financave për ecurinë e punimeve tek koncesioni i inceneratorit, për sa kohë NJZP ishte pa kryetar. Nga sa më sipër ministria e Financave ju sjell në vëmendje se sipas ligjit të koncesioneve, përcjellja e raporteve periodike të monitorimit pranë ministrisë së Financave është përgjegjësi e Autoritetit Konktraktor,” i drejtohet Ibrahimaj në 9 maj 2022 ministrisë së Infrastrukturës dhe Bashkisë së Tiranës.

Delina Ibrahimaj i kujton Belinda Ballukut se kryetari i NJZP duhet te jete nga Autoriteti Kontraktor

Shkresa e Delina Ibrahimaj ja ngarkonte Belinda Ballukut përgjegjësinë për të emëruar kryetarin e NJZP. (Më vonë mes Ballukut dhe Ibrahimajt do të shpërthente një konflikt i ashpër, i cili kulmoi me sherr në mbledhje qeverie, çka u pasua me transferimin e Ibrahimajt nga ministre finance në ministre për sipërmarrjen.) Por dy muaj para kësaj shkrese, qeveria kishte miratuar një vendim, i cili e hiqte sektorin e mbetjeve nga fusha e përgjegjësisë shtetërore e ministrisë së Infrastrukturës duke e lënë atë jetim. Ky vendim ishte goditja finale, që shpartalloi totalisht kontrollin mbi inceneratorin.

Në 15 gusht të vitit 2022, katër anëtart e mbetur të NJZP zhvilluan mbledhjen e fundit. Pas kësaj mbledhje dorëhiqet një tjetër anëtare. Ada Oseku, përfaqësuese e ministrisë së Infrastrukturës njofton dorëheqjen duke arsyetuar se tashmë funksionimi i NJZP kishte rënë edhe ligjërisht, për shkak të vendimit të marsit 2022, që hoqi përgjegjësinë e mbetjeve nga ministria e Infrastrukturës.

As a result, after August 2022, NJZP remained with only 3 members; Arben Kaçorrin from AKUM as a representative of MIE and the two members of Tirana Municipality, Enris Toska and Henrik Hysenbegasi. For almost more than two years, the concession of the Tirana Incinerator has been practically without contracting authority since no one was able to make decisions. During this time, there was also a strong clash between Belinda Balluku and Mirela Kumbaro, as the Ministry of Infrastructure pushed to transfer the Contracting Authority to the Environment Ministry, but Mrs. Kumbaro refused.

Two months ago, the government approved a decision to establish the National Waste Agency, giving it legal responsibility for implementing waste policies. But, this agency is still not functional, prolonging the vacuum more. This is the story of how the supervision of the incinerator was destroyed and the reason why SPAK's investigations have also been extended to the Ministry of Infrastructure and Energy, through the seizure of the phones of many high officials of this ministry.

A story where the clashes between two powerful figures in power, Belinda Ballukut and Erion Veliajt, left the state blind in the big affair of the incinerator, where the money was paid in droves, while no one had the courage to officially write that the incinerator was not being built.
