Parliament confirms two Constitutional Court Judges; Opposition and President

The Assembly voted in Monday’s plenary sitting to confirm Elsa Toska and Fiona Papajorgji as Constitutional Court Judges, respectively with 105 votes in favor and two against and 105 votes in favor and three against. They did so, regardless of an appeal issued by the President of the Republic on the MPs not to vote two judges, as, according to him, the legislative body could only confirm one judge in the office at this time. Democratic Party Secretary-General Gazmend Bardhi said in a reaction to the Parliament vote that the coup d’état against the Albanian Constitution continued. The President’s Spokesperson said that the so-called Ramaform was ongoing and that the Head of State would comment on this development upon his return from an official visit abroad.

The United States Embassy to Albania reacted on the Parliament’s voting through a Facebook post, stating that, “Since justice reform passed unanimously in 2016, Albanian institutions, including new independent judicial bodies, have been working hard to fulfill the will of the people. Parliament’s vote today brings Albania forward in re-establishing the Constitutional Court, a vital judiciary body for democratic checks and balances. The United States remains committed to supporting the formation of an independent and honest judiciary in Albania.”

The European Union Delegation to Albania also reacted to the Parliament’s voting via a Twitter posting: “Today, the Albanian Parliament has elected two new members of the Constitutional Court. We welcome this decision and we look forward to having a functional Court in place as soon as possible. The implementation of justice reform continues and is essential for Albania on its EU integration path.”

In a Facebook posting, the German Embassy in Tirana said that on the way to a functional constitutional court, it is important that all actors now fulfill their responsibilities in appointing constitutional judges and not lose sight of the goal. The German Embassy said they welcomed the Albanian Parliament’s vote in this regard. The German Embassy further said that in its resolution of 26 September 2019, the German Bundestag underlined the importance of restoring the functionality of the Albanian Constitutional Court to Albania’s EU accession process. They further said that Germany would continue to support Albania in strengthening justice and the rule of law.
