Serbia Has Still Not Fully Implemented None of the 13 Corruption Prevention

Serbia still has not fully implemented none of the 13 corruption prevention recommendations contained in the Group of States against Corruption (GRECO) evaluation report, it was announced on Tuesday.

“Serbia has implemented satisfactorily or dealt with in a satisfactory manner none of the thirteen recommendations contained in the GRECO’s fourth round evaluation report. Ten recommendations have been partially implemented and three have not been implemented”, the GRECO said in an interim compliance report, published on Tuesday.

The adoption of a code of conduct for MPs should be a priority, as well as further measures to improve the transparency of the legislative process, to allow for adequate timeframes and debates on draft legislation and to avoid the use of urgent legislative procedures unless, in exceptional circumstances, the report said.

As regards judges and prosecutors, GRECO is concerned about the “rather acrimonious environment in which the consultation process has taken place, with various non-governmental organizations, including the Judges’ Association and Prosecutors’ Association, withdrawing from the process, and the criticism of not only these organizations but also the Consultative Council of European Judges on some aspects of the draft constitutional amendments”, the report said.

Still, despite the fact that none of the recommendations have been implemented, GRECO concluded that the overall level of compliance with the recommendations is no longer "globally unsatisfactory".

The fourth evaluation round report on Serbia was adopted by GRECO in 2015. In the compliance report adopted in 2017 and made public in 2018, it was concluded that Serbia had not implemented satisfactorily or dealt with in a satisfactory manner any of the 13 recommendations contained in the fourth round evaluation report.

In the first official reaction to the publication of the interim compliance report, the Justice Ministry has, predictably, attempted to give a positive spin to GRECO’s conclusion, placing in the foreground the estimate that the overall level of compliance with the recommendations is no longer “globally unsatisfactory”.

“Serbia is no longer on the list of globally unsatisfactory countries concerning the fight against corruption, it was pointed out in the GRECO latest interim compliance report”, underlines the statement from the Ministry.

Seeing that the majority of the 13 recommendations concern constitutional amendments, the Council of Europe could not treat the progress made in the fulfillment of the recommendations as completely met, until the Serbian Constitution is changed, concludes the Ministry.

“Bearing in mind that many processes are ongoing, GRECO concluded that more than 75% of the recommendations have been partially fulfilled”, it is added.
