The odyssey of Olta Xhaçka's mandate seems to be coming to an end. The statement of deputy Olta Xhaçka that her case was judged on its merits and the Constitutional Court did not ask the Assembly to make a decision, so that it could then examine the case, was rejected by the Constitutional Court. Today, this institution asked the assembly to bring to the Constitutional Court the motion for the incompatibility of this mandate. Implementation of the decision is an indisputable legal obligation.
I have been to the Constitutional Court, my case was judged on the merits, not on procedural aspects, because if it were so, it would have been dismissed in the Counseling room. It was heard [the defense] for 10 hours and it was disposed of with a decision to rest" - said Olta Xhaçka in Top Story on April 11, 2024.
This statement of Mrs. Xhaçka is today opposed by the Constitutional Court, which has taken a clear decision on the legal obligation of the Parliament of Albania to bring for review the motion of incompatibility of Olta Xhaçka's mandate.
The Constitutional Court decided on Wednesday, July 10 (2024) to compel the Assembly to send the motion on the incompatibility of Olta Xhaçka's mandate to this court for consideration.
The Constitutional Court has conveyed a clear legal obligation for the Assembly when it says that no one is above the law.
"No one can decide not to execute the decision of the Constitutional Court. The power of the decisions of the Constitutional Court is equal to the power of the law. Not to implement the decision of the Constitutional Court means not to implement the Constitution and the law", said the president of the Constitutional Court, Holta Zaçaj, after reading the decision for three minutes.
But which decision did the Assembly not implement? Simply put, on January 23, 2023, the Constitutional Court accepted the request of a group of deputies from the DP to bring Olta Xhaçka's mandate to the Constitutional Court for review.
Further, the Assembly with the majority of votes of the SP decided "On not sending the motion for the mandate of Olta Xhaçka to the Constitutional Court".
A second group of deputies from the DP headed by Gazment Bardhi opposed the above decision, asking the Constitutional Court to declare that decision as incompatible with the Constitution.
The motion of the DP group was related to the follow-up of the parliamentary procedure for finding the invalidity and the end of the mandate of deputy Olta Xhacka.
Gazment Bardhi requested in the public session held in the Constitutional Court the resolution of the conflict of powers between the Assembly and the constitutional subject in conflict (not less than 1/10 of the deputies), how to exercise the constitutional right of the parliamentary minority (in this case of one tenth of the deputies) so that their motion is not obstructed by the Assembly, this request was accepted by the Constitutional Court
Përfaqësuesi ligjor i Kuvendit, në seancën publike, argumentoi se, ndryshe nga sa pretendonte pala tjetër, Kuvendi e kishte zbatuar vendimin e Gjykatës Kushtetuese sa kohe që deputetët ishin vënë në lëvizje për ta shqyrtuar qysh me Këshillin e Rregullores e deri tek seanca dhe në fund kishin dalë në përfundimin se nuk plotësoheshin kriteret formale për ta çuar mandatin e Olta Xhaçkës në Gjykatën Kushtetuese
Gjykata Kushtetuese nga ana e saj ka vlerësuar ndryshe.
Vendimi
Gjykata Kushtetuese, pasi shqyrtoi çështjen në seancë publike me pjesëmarrjen e palëve, konstatoi se vendimi për mos dërgimin e mandatit të Xhaçkës në Kushtetuese nuk është ekzekutuar nga Kuvendi i Republikës së Shqipërisë.
Gjykata vlerësoi se përmes këtij vendimi, Kuvendi i Shqipërisë ka vënë në diskutim fuqinë detyruese të vendimit të saj, duke mos zbatuar nenin 132, pika 1, të Kushtetutës, i cili parashikon se vendimet e Gjykatës Kushtetuese janë përfundimtare dhe të detyrueshme për zbatim.
“Gjykata ritheksoi se vendimet e saj kanë efektet e forcës së ligjit. Asnjë organ nuk ka të drejtë t’i vërë ato në diskutim dhe aq më tepër të mos pranojë t’i zbatojë. Ndikimi i padiskutueshëm i vendimeve të saj është i tillë që ju imponon të gjithë organeve shtetërore fuqinë detyruese të vendimit të saj. Ky efekt detyrues ka të bëjë si me pjesën urdhëruese, ashtu edhe me pjesën arsyetuese të vendimit”, thuhet në vendim.
Gjykata theksoi gjithashtu se vendimi për detyrimin e Kuvendit për të dërguar në Gjykatë mocionin e 1/10 së deputetëve për papajtueshmërinë e mandatit të deputetit, sipas nenit 70 të Kushtetutës, është i detyrueshëm për zbatim.
“Kjo do të thotë se Kuvendi (deputetët e tij) duhet të votojnë në përputhje me urdhërimin e Gjykatës, pasi ky votim nuk është një procedurë e zakonshme parlamentare dhe si e tillë nuk ka të bëjë me parimin e mandatit jodetyrues të deputetit, por është në kuadër të ekzekutimit të vendimit të Gjykatës”.
Gjykata vendosi detyrimin e Kuvendit për dërgimin sa më parë në Gjykatën Kushtetuese të mocionit mbi papajtueshmërinë e mandatit të deputetes Olta Xhaçka.
Por kur? Kryetarja e Gjykatës Kushtetuese nuk dha afate konkrete.
“I mbetet politikës të vendosë nëse do të dojë të zbatojë konform asaj që kemi vendosur, pra që ta sjellë çështjen me përparësi. Ne nuk kemi vendosur afate…”, tha kryetarja Holta Zaçaj pas interesimit të medias.
(Kërkesa e dytë e grupit të PD-së lidhej me faktin se Gjykata Kushtetuese duhet të bënte edhe një interpretim përfundimtar të neneve 70, pika 1 dhe 4; 73, pika 1; dhe 132, pika 1, të Kushtetutës, duke individualizuar edhe përgjegjësinë e deputetëve në rastet kur pengohet zbatimi i një vendimi të Gjykatës Kushtetuese).
Në fund të prononcimit të shkurtër rreth kësaj çështje, Zaçaj sqaroi shkurt edhe një tjetër pikë lidhur me mandatin e Olta Xhaçkës.
Paralelisht gjykata ka rrëzuar kërkesën e fundit të PS dërguar përmes Kuvendit.
The Assembly addressed a request to the Constitutional Court, where it requested the re-opening of the judicial review regarding Xhaçka's mandate, in order to seek an advisory opinion from the European Commission for Democracy through Law (Venice Commission).
Help was requested with the argument that lawyers in Albania are facing legal uncertainty regarding this case.
"Situated in the conditions where a legal uncertainty is created, as to why the group of no less than 1/5 of the deputies cannot set the Constitutional Court in motion contrary to the constitutional order in force, the Assembly is of the opinion that an opinion should be requested advisory by the Venice Commission", it was stated in the request of the Assembly addressed to the Constitution.
The President of the Constitutional Court announced that the above request has been dismissed.
