Supreme Court: The appeal favored Dritan Dajti with a reduced sentence

The Supreme Court has clarified the decision to sentence Dritan Dajti to life imprisonment. The latter is accused by the Prosecution of Serious Crimes for the murder of 5 people in Durrës, among them 4 operatives of the Operational group, Fatos Xhani, Sajmir Duçkollari, Altin Dizdari and Kastriot Feskaj.

The event happened on August 7, 2009.

In a 74-page decision, the criminal panel of this court, Ilir Panda, Artur Kalaja and Sandër Simoni, argued that the Court of Appeal for Serious Crimes acted incorrectly in resolving the legal situation, favoring Dritan Dajti, for the removal of the prison sentence life and his sentence of 25 years in prison.

According to the Supreme Court, the favor in the Appeal came by accepting Dajti's request for a shortened trial, reducing the sentence to 1/3.

The three judges of the Supreme Court say that decision No. 13 of February 8, 2019, which sentenced Dajti to 25 years in prison for the murder of 4 policemen, forgery of documents and possession of weapons without a permit, was taken in violation of Article 403 of the Code of Criminal Procedure as well as the unifying decision of the United Colleges of dated January 29, 2003.

Starting from this legal basis, the Supreme Court found reason to overturn the decision of the three judges of the Appeal for Serious Crimes, Aleks Nikolli, Petrit Aliaj and Skënder Damini, who removed Dajti's life sentence and gave him the sentence of 25 years imprisonment.
