The Supreme Court has come to the conclusion that the government has violated the status of the judge with the decision dated 12.06.2019 for the removal of diplomatic passports.

While emphasizing that the claims of the Council of Ministers do not have a direct constitutional nature. The Supreme Court says that the government removed the right to the financial benefit of paying for the service passport equipment from the budget of the institution where the judge exercises his office.

"Determining the violation of the judge's status through the removal of the service passport with the decision of the Council of Ministers no. 389, dated 12.06.2019, "On the criteria for the issuance of diplomatic and service passports", as an acquired right that cannot be reduced and that is in violation of Article 22 of Law no. 96/2016

Finding the illegality, due to the omission of the legal norm, of attachment 2 of the decision of the Council of Ministers no. 389, dated 12.06.2019, "On the criteria for the issuance of diplomatic and service passports", in the part that does not provide for judges as official subjects who have the right to be provided with a service passport", it is stated in the clarified decision of the court.
