Reporting to the File Authority, the Prosecutor's Office of Tirana

Notice of the prosecution:

The Prosecutor's Office of the Judicial District of Tirana has decided not to initiate criminal proceedings against the Authority for Information on Former State Insurance Documents for some criminal offenses.

The Prosecutor's Office of the Tirana Judicial District, on the basis of the report of citizen Ilir Metaj and the material received from the Special Prosecutor's Office against Corruption and Organized Crime, has registered the criminal report no. 11409 dt. 06.09.2022.
During this period, the relevant verifications provided for by the criminal procedural law were carried out and related in the present case to the receipt of relevant statements in the capacity of persons who show the circumstances of the investigation, of AIDSSH members against whom this criminal report is directed.

The complainant has presented his claim on the specific case, just as the accused have submitted the procedure followed in such a case, but also the procedure that the complainant should have followed in such a case, although the complainant has appreciated that the actions of AIDSSH members were committed in violation of the law.

In our assessment, based on what is contained in the criminal report no. 11409 of 2022 and furthermore the legal basis on which the Authority for Information on Former State Insurance Documents (AIDSSH) has operated, makes us unable to find ourselves in the circumstances for the registration of the proceedings criminal, related to the existence of the image or images of the criminal offense or offenses.

So, there are circumstances that do not allow the initiation of criminal proceedings, these circumstances are provided for by article 290/1 letter "ç" of the Penal Code.

As above, in support of Article 291/1/2 of the Criminal Code, on 21.09.2022 it was decided not to start the criminal proceedings.
