From suspicious borrowing to inaccuracies in declarations, what did the KPK reveal about the head of the Lezha Prosecution Office, Erjon Shehaj?

The Head of the Lezha Prosecution Office, Erjon Shehaj, will face the Special Appeals Chamber today, as part of the Vetting process.

The decision to confirm him in office by the KPC was appealed by the Public Commissioner.

The career and abuses committed by Shehaj were also part of the investigation of the "Vetting" show on News24 just a few days ago.

Excerpts from the investigation:

Erjon Shehaj began his career in the judiciary as an officer of the Judicial Police and was appointed prosecutor in June 2012. From that period onwards, Shehaj has been working at the Lezha District Prosecutor's Office, where he has been the head of this Prosecutor's Office since April 2021. This prosecutor's CV does not indicate where he completed his education, since the KPK's assessments are also related to professional criteria.

On April 1, 2022, the Independent Qualification Commission would confirm the head of the Lezha Prosecution Office, Erjon Shehaj, in office, after being convinced by the explanations regarding his assets and the cases found in the professional criteria, for which he had been asked to provide explanations.

The Vetting process for Chief Prosecutor Shehaj was conducted by Alma Faskaj, with rapporteur Pamela Qirko and member Brunilda Bekteshin, and Theo Jacobs was present as an international observer.

Two months later, Public Commissioner Florian Ballhysa would appeal the decision of the Independent Qualification Commission, requesting the dismissal of Prosecutor Shehaj for professional criteria issues.

But the head of the Lezha Prosecutor's Office has not only had problems with the professional criteria, but also with inconsistencies with asset declarations. In the Vetting process, asset analysis is one of the three pillars of re-evaluation for prosecutors, along with background checks and assessment of professional skills.

It is noteworthy that in the initial declaration of assets in 2004, Prosecutor Shehaj did not own any assets, while at the end of 2019, his family assets amounted to 11.1 million lek or 111 thousand euros.

Through a qualitative analysis of Shehaj's asset declarations, BIRN has identified as "red flags" the loans used as a source for wealth creation. These loans are worth 2.5 million lek in 2009, 14 thousand euros in 2013 and 3.3 million lek in 2017.

Specifically, in 2014, Shehaj ended up with insufficient financial resources in the amount of 8 million old lek. In this year, he declared the revocation of a 2009 enterprise contract and the conclusion of a new contract for the sale and purchase of an apartment of 84 m2 + 10 m2 of common area, with an added value of 13.5 thousand euros.

Ka qenë vetë Komisioni i Pavarur i Kualifikimit që ka vlerësuar se, nga analizimi i pasurive të Erjon Shehaj, janë konstatuar disa pasaktësi në deklarim.

Ndryshe nga Inspektorati i Lartë i Deklarimit dhe Kontrollit të Pasurive dhe Konfliktit të Interesave, ILDKPKI që nuk ka gjetur asnjë problem në deklarimet e pasurisë dhe për burimet e krijimit të këtyre pasurive, KPK-ja ka konstatuar pasaktësi, mospërputhje dhe mungesa financiare.

Komisioni ka gjetur mospërputhje në deklarimet për gjendjet cash në vite, pasi në këto të fundit ka shënuar shumën 350 mijë lekë dhe vlerën 1450 euro, ndërsa në përllogaritjen e shumave të pasqyruara në deklaratat vjetore duhej të disponohej shuma 1.4 milionë lekë.

Pavarësisht disa mospërputhjeve financiare, Komisioni i Pavarur i Kualifikimit e ka kaluar Shehajn për këto pasaktësi pasi nuk e bëjnë të pamjaftueshëm deklarimin e pasurisë.

Komisioneri Ballhysa nxjerr me probleme te aftësitë profesionale

Sipas Komisionerit Publik Florian Ballhysa, në rastin e prokurorit Erjon Shehaj nga aktet e administruara paraqiten gjetje dhe rrethana ligjore e faktike që nuk plotësojnë kriteret dhe standardet e etikës, të cilat garantojnë mbrojtjen dhe forcimin e besimit të publikut.

Në ankim evidentohet fakti se Komisioni i Pavarur i Kualifikimit ka evidentuar gjetje në të gjitha burimet e vlerësimit të kriterit të aftësive profesionale, si në raportin e hartuar nga Këshilli i Lartë i Prokurorisë, por edhe denoncimet nga publiku.

Por cilat janë çështjet që pengojnë kalimin përfundimtar të Vettingut?

Në informacionet e siguruara nga emisioni “Vetting” rezulton se Shehaj ka patur një përplasje ligjore me avokatin Ded Guri.

Konkretisht në vitin 2015 në Prokurorinë e Lezhës është administruar një zarf, brenda të cilit kanë qenë dy letra kërcënuese drejtuar ish-drejtuesit të Prokurorisë Lezhë Përparim Vukaj dhe prokurorit Erjon Shehaj. Kjo çështje është marrë nën hetim nga ky i fundit, por vetë trajtimi i çështjes nga Shehaj ka konflikt interesi, fakt që mbështetet edhe nga Komisioneri Ballhysa.

Kjo çështje do të apelohej në Gjykatën e Apelit Shkodër dhe në të do të nxirreshin konkluzione, që rrëzonin masat e marra nga prokurori Shehaj përsa i përket hetimeve.

Në vendimin e Gjykatës së Apelit Shkodër më 20 maj 2015 do të shfuqizohej vendimi i Gjykatës Lezhë pasi arrestimi i avokatit Ded Guri dhe masa e sigurisë ishin të pavlefshme sepse ligji e ndalonte që Prokurori të hetojë një çështje ku është i përfshirë vetë dhe nuk kishte prova që implikonin avokatin si autor të letrave kërcënuese.

Në vendim evidentohet që letra kërcënuese i është drejtuar prokurorit Shehaj dhe për këtë arsye ai duhet të mos e kishte pranuar këtë çështje.

But lawyer Ded Guri would not put an end to this case where it turned out that he was not involved in any illegal action, gaining innocence. Immediately after this decision, lawyer Guri would file a lawsuit for the case in question, accusing the current head of the Lezha Prosecutor's Office, Erjon Shehaj, of abuse of office, a case which after many twists and turns ended up in the custody of the Kurbin Court. The prosecution in this case would request the dismissal of the case, while the reasoning of the Court's decision is also interesting.

According to the arguments in the Kurbin Court's decision in December 2021, this Court would assess that on the part of Prosecutor Shehaj, there could potentially be a criminal offense in the actions and omissions of the latter. In this case, according to Article 313 of the Criminal Code, a fine or up to 5 years in prison may be sought.

The reasoned decision by the Court states that the case for the criminal prosecution of Erjon Shehaj is time-barred as more than 5 years have passed since the unlawful arrest of lawyer Ded Guri was ordered.

Despite the arguments presented by the head of the Shehaj Prosecution Office, according to the Public Commissioner, circumstances have been found in this case, which, according to the law in force, oblige the prosecutor to abandon the investigation of the case, when there are interests related to the latter.

In the decision to confirm Erjon Shehaj's Vetting process, the Independent Qualification Commission has forwarded this file for review to the High Inspectorate of Justice.
