The appeal of GJKKO has sentenced the former state attorney, Irgen Kërçuku, to two years in prison.
The Special Court of Appeal for Corruption and Organized Crime, with a panel composed of judges Saida Dollani (chairman), Florjan Kalaja (member), and Daniela Shirka (member), on 16.09.2024, announced the decision regarding the case of registered with no. 36 act, date 27.05.2024 registration, on the appeal of the appellant/defendant IK, against decision no. 77, dated 16.11.2023 of the Special Court of First Instance for Corruption and Organized Crime, which decided:
1. The guilty declaration of the defendant IK for committing the criminal offense "Passive corruption of persons exercising public functions", provided for by Article 259 of the Criminal Code (before the amendments to Law No. 43/2021) and his sentence of 3 years imprisonment.
2. Pursuant to Article 406/1 of the Code of Criminal Procedure, the defendant IK is reduced by 1/3 (one third) of the sentence given, being finally sentenced to 2 years of imprisonment.
3. The serving of the sentence begins from the moment of execution of this decision, where the calculation includes the period of stay with the security measure "House arrest" and is carried out in a regular security prison.
4. In application of Article 35/1 of the Penal Code, the defendant IK is deprived of the right to exercise public functions for a period of 5 years.
5. Procedural costs in the stage of preliminary investigations as well as court costs are charged to the defendant.
6. Against this decision, an appeal is allowed by the prosecutor and the defendant in the Special Court of Appeal for Corruption and Organized Crime, within 15 days, starting from the day after the communication of the decision.
In conclusion, the Special Court of Appeal for Corruption and Organized Crime decided:
- Enforcing decision no. 77, dated 16.11.2023 of the Special Court of First Instance for Corruption and Organized Crime.
– Court costs are charged to the defendant IK
