Hashim Thaçi and Smakaj plead not guilty to the charges, Fazliu pleads not guilty

Former Kosovo President Hashim Thaçi and former head of the Kosovo Intelligence Agency Bashkim Smakaj have not commented on the indictment filed against them for witness tampering. Meanwhile, Kosovo Liberation Army veteran Fadil Fazliu has pleaded not guilty.

Thaçi was the first to appear before the Specialist Chambers in The Hague. During the hearing, he said that he would not enter a plea, as he had not read the indictment in its entirety.

In his presentation, Thaçi said that "all of a sudden 2-3 days ago" he was notified of the new indictment and did not have time to discuss the substance of this document with his defense team.

"All of a sudden, 2-3 days ago, I was notified of the new indictment by the Specialized Prosecutor's Office. I know that Kosovo is on the verge of general elections. But, I am not part of the electoral race, I do not pose a danger to anyone. Therefore, I ask today - I respect and believe in the Constitution and laws of Kosovo - from everyone, wherever you are sitting, on whatever side or in whatever uniform you are in this hall, to respect the Constitution and laws of Kosovo," said Thaçi.

The accused before the Specialist Chambers have 30 days to enter their pleas regarding the charges brought against them.

 "I haven't read them in their entirety yet, so I need to read them to understand them," said Thaçi.

After Thaçi's statement, the judge requested a short break, as Thaçi's lawyer asked for time to give him instructions.

After this, Thaçi explained that when he was initially asked by the judge if he understood the charges against him, he had not understood the question well.

The judge asked the parties to set a date for Thaçi to enter his plea. The defense said it agreed that Thaçi would enter his plea on the indictment on January 7, 2025. Judge Marjorie Masselot said she would issue a ruling on the matter later.

During the first appearance, which lasted almost 45 minutes, Thaçi said that he, his family, and Kosovar society await the conclusion of the process against him and that he expects justice.

Judge Marjorie Masselot decided that Thaçi should remain in the detention center due to the other case against him, despite defense attorney Nina Tavakoli saying there is no risk that his client will escape.

A new indictment was filed against Thaçi, former Minister of Justice Hajredin Kuçi, former head of the Kosovo Intelligence Agency Bashkim Smakaj, former mayor of Malisheva Isni Kilaj, and Fadil Fazliu on November 29, and was made public on December 6.

Në nisje të seancës, gjyqtarja e procedurës paraprake, Marjorie Masselot, bëri përmbledhjen e rastit kundër pesë të akuzuarve dhe ai lexoi të drejtat Thaçit. Ndërkaq, nga Zyra e Prokurorit të Specializuar u lexuan akuzat që rëndojnë ndaj Thaçit dhe katër të akuzuarve të tjerë.

Ndërkaq, në paraqitjen e tij të parë para Dhomave të Specializuara, Bashkim Smakaj, tha se dëshiron të shfrytëzojë periudhën 30-ditore për t’u deklaruar për akuzat ndaj tij.

Ai tha në gjykatë se pas konsultimit me avokatin mori këtë vendim, pasi që pret të marrë edhe materiale shtesë për rastin kundër tij.

Avokati i tij kërkoi lirimin nga paraburgimi dhe tha se Smakaj është i gatshëm të japë garancë 5 mijë euro për lirimin me kusht dhe të dorëzojë pasaportën e tij. Mbrojtja argumentoi se ai nuk paraqet rrezik që të arratiset.

Prokuroria, ndërkaq, tha se nëse Smakaj do të lirohej me kusht, ai do të mund të ndërhyjë te dëshmitarët apo të kryejë vepra të tjera penale.

Gjyqtarja, pas një pauze të seancës, tha se argumentet e mbrojtjes nuk ishin të mjaftueshme për të ndryshuar vlerësimin e saj sa i përket qëndrimit në paraburgim të Smakajt. Ajo tha se ndaj Smakajt qëndron vendimi i saj për paraburgim prej dy muajsh.

Seanca e tretë ishte paraqitja e Fadil Fazliut para Gjykatës në Hagë. Ai tha se para seancës është konsultuar me avokatin e tij dhe u deklarua i pafajshëm për akuzat ndaj tij.

“Kam biseduar edhe me avokatin para një ore. Por, unë jam i pafajshëm, deklarohem i pafajshëm“, tha ai.

Edhe në rastin kundër Fazliut, gjykatësja nuk pranoi argumentet e mbrojtjes për lirimin e tij nga paraburgimi.

Aktualisht në Hagë është duke u zhvilluar gjykimi ndaj Thaçit dhe ish-krerëve të tjerë të Ushtrisë Çlirimtare të Kosovës, Kadri Veseli, Jakup Krasniqi dhe Rexhep Selimi, të cilët akuzohen për krime lufte dhe krime kundër njerëzimit.

Më 5 dhjetor, Kilaj, Smakaj dhe Fazliu u arrestuan dhe një ditë më pas u dërguan në qendrën e paraburgimit në Hagë. Ndërkaq, ndaj Kuçit gjykata ka lëshuar fletëthirrje për t’u paraqitur para Dhomave të Specializuara të Kosovës, me seli në Hagë. Kuçi do të bëjë paraqitjen e parë para gjykatës më 9 dhjetor. Po atë ditë, paraqitjen e parë do ta bëjë edhe Isni Kilaj. Ai ishte paraparë të paraqitej të dielën, por mbrojtja e tij ka kërkuar që seanca të shtyhet për një ditë.

Thaçi akuzohet se bashkërendoi “tri grupe të veçanta” së bashku me Smakajn, Kilajn, Kuçin dhe Fazliun për të ndikuar në dëshmitë e dëshmitarëve të Prokurorisë në rastin kundër tij dhe të tjerëve për krime lufte.

The indictment alleges that the criminal offenses against the administration of justice were committed from April 12, 2023 to November 2 of that year, during non-privileged visits to the detention facility in The Hague between Thaçi and other accused persons.
