Seizure of justice by the government, ECHR demands accountability from Albania

The European Court of Human Rights in Strasbourg has published on its official website the cases open before it, including that of Jamarbër Malltez. This relates to Malltez's civil lawsuit against Taulant Balla for allegations made in connection with the privatization process of the former Partizani complex.

In a reaction on Facebook, Malltezi writes that unlike Albanian institutions which, under the dictates of the party, hold files hostage, the ECHR holds Albania accountable for serious violations.

The European Court of Human Rights in Strasbourg has published on its website several open cases before it regarding human rights violations by Albanian courts. Among them, the case Malltezi v. Albania stands out, which is related to the civil lawsuit process of Jamarber Malltezi against Taulant Balla for his defamation regarding the privatization process of the former Partizani club. The same defamation on which the party's SPAKU initiated criminal proceedings.

It was clear from then on that Taulant Balle's statements were fraudulent. He was unable to present any evidence in court, so he was convicted by the first instance court for defamation.

The Appeals Court panel, according to Balla's request, dismissed the judges of the panel selected by lot without legal cause. The selected panel considered the defamation "freedom of expression of the deputy" which meant that Balla was free to deceive without evidence and overturned the first instance decision.

Under the political dictate of the party-state, the file was held hostage for 8 years, without being tried in the Supreme Court.

In May 2022, the Supreme Court (after being reinforced with dozens of militants from Soros' East-West Institute under the control of Delina Fico) announced that the trial date would be 25.05.2022, but a few days later issued an announcement that the cases that were to be tried on 25.05.2022 would be postponed to another date. No date was subsequently announced either to the parties or publicly.

In mid-September 2022, Prof. Malltez's lawyer learned that the Appeal had been dismissed in an unannounced hearing, on 06.06.2022.

Meanwhile, prosecutor Millonai, promoted by Taulant Balla to SPAK, seized the civil file, preventing Mr. Malltezi's defense from filing an appeal with the Constitutional Court, despite the defense's continuous requests. The seizure of the civil file (sometimes unheard) violated the constitutional rights to due process.

3 months after the announcement of the Supreme Court's decision, in December 2022 the lawyer filed an appeal with the Constitutional Court without being able to file the court file, which political prosecutors held hostage on behalf of Taulant Balla. 3 judges of the Lepe-Peqe division of the Constitutional Court, packaged by Soros reform, decided not to proceed to the hearing of the appeal due to "the expiration of the 4-month appeal deadline" after calculating the deadline from the date of the unannounced trial and not from the date the decision was given to the parties.

As can be seen from the announcement on the website, the ECHR is holding Albania accountable for these serious human rights violations that are the result of the political capture of justice in Albania. The bells are ringing for the oppressors.
