BKH leader Aida Hajnaj seeks a second 5-year mandate

The Special Prosecution Office has initiated the reappointment procedure for the head of the National Bureau of Investigation, Aida Veizaj Hajnaj, after the latter expressed interest in a second 5-year term on March 28.

SPAK told BIRN in a written response that, referring to Law 95/2016 on the special anti-corruption structure, at this stage the candidacy of the acting director is being evaluated exclusively.

"Since we are dealing with a reappointment process, this process is addressed only to the acting Director, who must again meet all legal criteria and pass all testing phases provided for by Law No. 95/2016," the Special Prosecution Office stated through its spokesperson.

"In the event that the incumbent Director does not pass all the selection stages of the reappointment procedure, the Commission concludes this process and opens the appointment procedure through an open competition, where all candidates who meet the legal criteria for the position of Director of the BKH can apply," SPAK added.

The National Bureau of Investigation is the specialized structure of the Judicial Police, which carries out investigative actions under the direction of the Special Prosecution Office.

The anomaly of the process of selecting the new head of the National Bureau of Investigation has its roots in Article 33 of the law on the organization and functioning of anti-corruption institutions, which limits the open competition between candidates to the right given to the current leader to be reappointed for a second 5-year term.

However, the law provides in Article 6 that no candidate may be appointed to office without first meeting security requirements; such as background and asset checks, as well as giving consent for themselves and their family members to periodic checks of bank accounts and telecommunications.

Aida Veizaj Hajnaj was appointed as the first director of the National Bureau of Investigation by the High Prosecutorial Council on July 30, 2020. Until then, she held the position of Deputy Director of the State Police, a position she had held since 2018. Previously, she served as the director of the Border and Migration Department at the State Police.

The verification procedure for the acting head of the BKH, Aida Veizaj Hajnaj, is being carried out by the Selection Commission, composed of the head of SPAK, Altin Dumani, and prosecutors Arben Kraja and Behar Dibra.

If the incumbent successfully passes the verification stages, her name will be proposed for a second term to the High Prosecutorial Council. Hajnaj did not respond to a request for comment from BIRN by the time of publication. Reporter.al
