Despite the fact that during 2024 there were 1760 vacant positions in the civil service, the final court decisions requiring the reinstatement of 134 people failed to be respected.

The Commissioner for Civil Service Oversight reported that the responsible institutions and units had the space to place these employees in regular positions, but this did not happen.

"At the time of verification, 134 final court decisions had not been executed. Undoubtedly, a delay in the execution of a decision can be justified in special circumstances, but the delay cannot be to such an extent as to damage the essence of the right."

"The law provides that the deadline for the execution of a final court decision is up to one year and the calculation of this deadline begins from the moment of communication of the executive title, until the implementation of all orders of the final court decision," the report states.

The Commissioner believes that a situation like this should make institutions aware of the consequences of delaying court decisions that have become final, as the financial damage caused to the state budget is considerable. Under current conditions, employees are being paid but not providing services.

"In this sense, a full realization of the obligation is not only in favor of the creditor to realize his right acquired by a court decision, but also serves the best possible administration of the state budget," the Commissioner underlines.

According to official data, the total number of final court decisions executed by the end of 2024 is 189 cases. It turns out that, for the period 03.01.2023 to 31.12.2024, state administration institutions were able to execute only 55 decisions or 29.1% of cases.

Analyzing the administered data, it results that, during the period 2023-2024, out of 116 supervised state administration institutions, 18 of them, including 10 ministries and 8 subordinate institutions, had the obligation to execute final court decisions, while the other 98 institutions reported that they did not have court decisions to execute./ Monitor
