Last year, 20 operators were excluded from the right to win tenders.

At least 20 economic operators lost their right to win public contracts due to violations found during the verifications.

Official data from the Public Procurement Agency show that 10 economic operators have been excluded due to misinformation and submission of documents containing false data in the tender.

Meanwhile, 10 economic operators have been excluded due to non-fulfillment of contractual obligations.

Last year, the PPA announced that out of 64 requests administered, administrative proceedings were initiated for 35 economic operators.

 At least 29 requests have resulted as incomplete in legal arguments and documentary evidence, or after verifications carried out, it has resulted that the conditions foreseen by the legal provisions for initiating administrative proceedings by the PPA were not met, or are in the process of being reviewed.

At the end of the administrative proceeding, the PPA reported that in addition to the 20 excluded operators, a decision was made not to exclude 4 economic operators from the right to win public contracts.

 Likewise, a decision was made to suspend the proceedings, due to the judicial process, for 7 economic operators and administrative proceedings continue for 4 economic operators.

In the report, the Public Procurement Agency highlights that for the decisions issued by it to exclude economic operators during 2024 (a total of 20 decisions), it results that only 11 decisions issued to exclude economic operators during this year have been appealed to the Administrative Court of First Instance.

In this regard, in 5 cases, the lawsuit was dismissed, in 1 case, the lawsuit was partially accepted, reducing the exclusion period, in 1 case, a stay of proceedings was ordered, while 13 cases are still in process./MONITOR
