The head of the SP parliamentary group, Bledi Çuçi, challenged the Constitutional Court in a press release where he spoke about Olta Xhaçka's mandate.

Çuçi stated that in their judgment as the majority, the Constitutional Court has tried to create a new legal norm by claiming that it has imposed on the deputies how to vote.

The Constitutional Court, he emphasized, has the right to annul an act taken by the Assembly if it deems it to be in conflict with the Constitution.

"The issue of the report of the Parliament with the CJK I think is a report that is clearly defined by the Constitution. The GJK has the authority to repeal any law, country, act passed by the Assembly if it deems it to be in conflict with the Constitution.

There was a decision of the GJK that annulled 2 decisions of the Assembly, and the Assembly undoubtedly does not discuss the decision, but it annulled them.

In this particular case, there is an ambiguity about the fact that one deputy or all should vote in a certain way, forced by a decision, not by what they think. This is a debate that has not found a solution even with the decision of the GJK.

On the contrary, the CJK in our judgment has tried to create a new legal norm, which the Constitution does not allow. It simply has to judge the existing norms. Deputies have the right to vote as they see fit. He knows the Constitution. Even the deputy is not even responsible for his vote. Article 73 provides for it. We thought of asking the Venice Commission for a final opinion to resolve the impasse", stated Çuçi.
