The Constitutional Court postponed the review of the Democratic Party's request to declare the law on the Academy of Sciences incompatible with the Constitution.

The hearing was postponed due to the absence of one of the judges.

Democratic MP Ina Zhupa expressed her concern about this postponement of the session, describing it as an unexpected and strange delay.

Zhupa stressed that he hopes that this delay will not negatively affect the process of reviewing the case and that the next session will be held with the presence of all members of the Constitutional Court.

"The surprise for us, but also for those of you who have followed the Constitutional Court for years, is that, after we settled into the courtroom to begin the trial, we were informed that a judge had fallen ill. We do not know the reasons or which judge, and for this reason we would have to cancel the session."

We were notified at that time, it's a bit strange, because I believe the judge should have notified us at least in the morning, or the day before, but I see that this constitutional court is functioning in a sick way, both in terms of procedures and the reasoning it gives in many decisions. I hope that this case will not be the same.

What we were left with is the next session, on January 28 at 10 a.m., also at the Constitutional Court. I hope that there will be a quorum, that all 8 members of the Constitutional Court will be present, and that we will hold the first session.

Today we were prepared to make all our submissions, we had received all the evidence, which are documentary documents, but also the official emails that were exchanged during the procedures, to argue something fundamental: the Academy of Sciences law is unconstitutional.

First, it is unconstitutional in substance, meaning the law itself, regardless of the procedure, even if a regular procedure had been followed, because the law violates the foundation of the constitution. The constitution states that all citizens are equal before the law, therefore all academics are equal before the law.

The innovation that this custom law created was the fact that 75-year-olds became emeritus academics, who could not lead, could not supervise, were not called members of the academy on a regular basis and were not part of the quorum.

"They may or may not vote, but only one of them, a 75-year-old emeritus, can be chairman, and this is Skënder Gjinushi, who can lead, can sign, can supervise, so have different powers from any other emeritus academic ," said Zhupa.
