25-year-old man dies in accident, prosecutor dismisses case without closing investigation

 For eight years, the Bozhanaj family from Durrës has been seeking to uncover the truth about a serious event that took the life of their family member, who was 25 years old at the time.

"On May 3, 2017, my brother had a car accident right where the flowers were located, and 5 days after the accident, he passed away," the victim's brother stated.

The victim had been a fuel manager for two years at the Spiecapag company, which was carrying out works for the "TAP" gas pipeline, and due to his work, he made frequent trips to the Korça area.

"He was coming from the camp located in Floq, towards Korça for work and right here he accidentally had an accident with two work cars, coming from the work site towards the camp. They were company employees and foreign citizens. One of French nationality and the other Dutch. According to the drivers' statements, they say that they saw a car that had lost control and was zig-zagging on this road, while the sketch of the scene says that my brother's car had driven about 30 m in a straight line, so here and with two tires off the road. That is, freeing up as much space as possible for the cars that were coming in front and right here, where there are also the signs of twisted iron bars, my brother had a T-shaped impact with one of the cars that was coming in front. My brother was more turned here and was hit on the passenger side by the other car's turn.

"What made my brother turn around and go back to the field? While he could have continued straight, he had driven his car off the road. The only thing that could have forced my brother in that direction was if one of those cars was overtaking and he drove his car off the road to make way for the other car. There is no other reason it could have happened."

This may be just a family claim, but now you need to be very careful, as these elements that we will list below say a lot about this event.

"In the sketch of the scene, this is shown as a straight road, when this is a double turn. The brother collided with the Frenchman, who was behind... this is also not clear... The statements of the drivers are contradictory to each other. We still do not know which of the cars shown in the accident the brother collided with, because the Frenchman says: my colleague saw the situation in the mirror and turned to help us, while the Dutchman on the other hand says that he was behind the Frenchman."

According to these photos and based on the statement, it is the French citizen's car that followed the deceased. But was the French citizen really the one driving this car? Let's keep it here for a moment.

“Ne dyshojmë që ndryshimi i orarit është bërë për mospërfitimin e sigurimit të jetës. Pas ndodhjes së aksidentit, makina e vëllait është dërguar në pikën e bllokimit të policisë, ndërkohë që dy makinat e tjera të kompanisë janë lënë në ruajtje në ambjentet e kompanisë. Nuk janë shoqëruar në pikën e bllokimit, për t’u hetuar si ka ndodhur etj. Dua të theksoj çfarë është më e rëndësishmja: ata janë thirrur në polici si persona që kanë dijeni për ngjarjen, jo si persona pjesëmarrës në aksident. Ata kanë vajtur në polici dhe pasi kanë dhënë deklaratat kontradiktore me njëra-tjetrën janë lënë të lirë, nuk janë mbajtur në vëzhgim nga policia në asnjë moment.

Por tani vijmë tek pjesa më e errët e hetimit të këtij aksidenti me pasoja fatale, sepse këtu faktet janë krejt të tjera nga ato çfarë kanë deklaruar dëshmitarët.

“Në përgjigjen që drejtoria e kufirit i kthen prokurorisë, thotë se francezi, i cili ka dhënë deklaratë në polici, që është përplasur me vëllain, thotë që ky shtetas ka dalë nga Shqipëria më datë 16 prill 2017 dhe deri në datën 7 qershor rezulton se ky person nuk ka hyre më në Shqipëri.  Ndërkohë që aksidenti ka ndodhur me 3 maj.”

Pra, sipas dokumentave zyrtare të drejtorisë së kufirit, francezi, personi që pretendohet se është përplasur me viktimën, nuk ka qenë aspak në Shqipëri në momentin e aksidentit. Kush duhet besuar në këtë histori? Kompania dhe prokuroria? Policia dhe Oficeri i Policisë Gjyqësore për procesverballin e vendit të ngjarjes apo gps i kompanisë? 

Elementë të paqartë edhe për 5 ekspertët që do të kryenin ekspertimin auto-teknik, të cilët janë shprehur se të dhënat e fiksuara nga grupi hetimor nuk përputhen me të dhënat e përfituara nga gps.

“Nga viti 2017 janë bërë 9 seanca gjyqësore. Të gjitha kanë qenë në favorin tonë, edhe në shkallë të parë edhe në apel. Gjykata gjithmonë e ka kthyer çështjen në prokurori për thellim të hetimeve, sepse gjykata nuk është e bindur të marrë një vendim në bazë të këtyre hetimeve që ka bërë prokuroria deri më sot. Gjyqi i fundit ka qenë në 2019, ku gjykata i ka lënë prokurorisë 3 muaj kohë për të mbyllur hetimet e kësaj çështjeje dhe 6 vjet më vonë, në 2025 kjo çështje është ende e hapur, pa autor.”
