Action in the Durrës Cadastre, the Prosecutor's Office issues 2 arrest warrants and one house arrest

The Durrës Prosecutor's Office has launched an action in the Durres Cadastre as part of an investigation into the alienation of properties.

It is about two arrest warrants and a house arrest for 2 employees of the agency.

It is known that the decision has been executed for the lawyer Jonida Mergeja (house arrest) and the beneficiary Ndue Mesiti (prison arrest), while the decision is expected to be executed for the former employee of the Cadastre Bled Zerba, announced as wanted by the police.

Referring to the incriminating material that in the Prosecutor's Office at the Court of First Instance of Durrës, the first investigative materials sent by the Special Anticorruption and Antievasion Unit at the Prime Minister's Office, which has exercised control at ASHK Durrës in relation to the Legalization Permit no. 263235, have been registered. , dated 18.04.2017 of Mr. Ndue and Ardjan Zef Mesiti, with cadastral area 1522, "Social Economic Building 1 Floor", construction plot area 500 m², construction area 274 m² in Durrës. From the verification of the documentation administered by ASHK Durrës, reasonable suspicions have arisen about a series of violations of a criminal and administrative nature, where it seems that employees of ASHK and other persons were involved, providing benefits in violation of the law. Following is the description of the case and the suspected violations.

On 25.06.2021, ASHK Central received a letter from IKMT for demolition of the building in cadastral area 1522 in Gjirin e Lalzi. This object is owned by Mr. Ndue and Ardjan Zef Mesiti, benefited from a legalization procedure in 2017 and on 10.10.2017 it was provided with a Certificate of Ownership by ZVRPP Durrës. Meanwhile, on 29.06.2021, Mr. Ndue Zef Mesiti made an application for updating the property card. After the arrival of the letter, doubts arose about the certificate of ownership of the object. From the verifications carried out by NJSAA, a number of anomalies resulted, leading to the conclusion that the practice is falsified.

From the verification of the protocol book of the former ZVRPP Durrës, that the data of the letter for the transfer of the file from the former Aluizni Durrës to the ZVRPP Durrës, do not match the data of the protocol books of the former ZVRPP Durrës, as the deadlines do not match the order number of documents. Planimetry and Genplan are not made according to the formats used by the office of ASHK Durrës. The volume sheet in the register is larger in format and has the name of the press it was printed on (unlike all the others) at the bottom. In ASHK Durrës, an audit was carried out for a legalization permit practice in April 2017 on behalf of citizens Ndue Zef Mesiti and Gentjan Zef Mesiti, where the audit showed that the signatures on behalf of citizens Kujtim Gjuzi, Mario Semini and Ilrjan Keçi were forged.

Në kuadër të hetimeve paraprake për proçedimin e sipërcituar është sekuestruar praktika e pasurisë me nr. 150/7/ND, në zonën kadastrale nr.1522, me nr.reference 1247, vol.7, faqe 26, në emër të shtetasit Ndue Zef Mesiti dhe Ardjan Zef Mesiti, praktikës që ka shërbyer për legalizimin e objektit në fjalë, si dhe çertifikatës për vërtetim pronësie për pasurinë në fjalë, praktikë e cila është dërguar për ekspertim grafik të akteve.

 

26, në emër të shtetasit Ndue Zef Mesiti dhe Ardjan Zef Mesiti, praktikës që ka shërbyer për legalizimin e objektit në fjalë, si dhe çertifikatës për vërtetim pronësie për pasurinë në fjalë, praktikë e cila është dërguar për ekspertim grafik të akteve.

Në bazë të aktit të ekspertimit grafik të shkrimit me nr.906, datë 24.02.2022, të Insitutit të Policisë Shkencore Tiranë, rezulton se aktet objekt hetimi (dokumentat e lëshuara nga ALUIZNI) nuk janë nënshkruar nga shtetasit Flamur Gjuzi, Ilirjan Keçi, Mario Semini, Olta Hani dhe Edlira Gjuzi. Aktet objekt hetimi (dokumentat e lëshuara nga ALUIZNI) nuk janë vulosur nga e njëjta klishe vule. Aktet objekt hetimi (Kartela e pasurisë nr. 150/7/ND, në zonën kadastrale nr.1522, me nr.reference 1247, vol.7, faqe 26, në emër të shtetasit Ndue Zef Mesiti dhe Ardjan Zef Mesiti) nuk është nënshkruar nga shtetasia Jonida Mergeja. Aktet objekt hetimi (Plan- Rilevimi në emër të shtetasit Zihni Dama) nuk është nënshkruar nga shtetasi Zihni Dama.

Në bazë të aktit të ekspertimit grafik të shkrimit të datës 09.05.2022, të ekspert Adrian Shehu, rezulton se në aktet objekt hetimi (çertifikata e pasurisë dhe harta treguese) vula e përdorur nuk është e njëjtë me modelet e lira të vulës që është përdorur nga ASHK Durrës në të njëjtën periudhë kohe, si dhe vula e përdorur në aktet (çertifikata e pasurisë dhe harta treguese) dhe aktin (kartela e pasurisë nr. 150/7/ND) nuk është e njëjtë, po ashtu nuk është e njëjtë me modelet e lira të vulës që është përdorur nga ASHK Durrës në të njëjtën periudhë kohe.

Aktet objekt hetimi (çertifikata e pasurisë dhe harta treguese) nuk janë shkruar dhe nënshkruar nga shtetasi Ardian Kona, por janë shkruar nga e njëjta dorë.

Aktet objekt hetimi (kartela e pasurisë nr. 150/7/ND) nuk është i të njëjtës serie prodhimi krahasuar me modelarët që paraprijnë dhe pasojnë.

Aktet objekt hetimi (kartela e pasurisë nr. 150/7/ND) në të gjitha rubrikat e saj janë shkruar dhe nënshkruar nga shtetasi

Me anë të shkresës përcjellëse me nr.19811/1prot., datë 11.11.2021, të ASHK Zyra Qëndrore Tiranë, rezulton se Leja e Legalizimit nr.263235, datë 18.04.2017, me nr.serial 0242084, i përket bllokut të lejeve që i përkasin Drejtorisë Vendore të ASHK-së Tepelenë, fakti ky i pasqyruar dhe me kopje të fletë- hyrjes.

Me anë të shkresës përcjellëse me nr.1773/1prot., datë 13.12.2021, të ASHK Drejtoria Vendore Tepelenë, rezulton se personi që ka administruar dhe shpërndarë Lejet e Legalizimit pranë kësaj drejtorie ka qenë drejtori Pëllumb Milori.

By means of the minutes dated 07.01.2022, the minutes on the delivery of legalization permits to employees Klejdi Abazi and Erenato Zaçe were administered by the director of ASHK to the Tepelen Local Directorate.

By means of the follow-up letter of ASHK Central Office Tirana, with no. 57/1prot., dated 21.01.2022, it turns out that it was referred to the IPS system, for property no. 150/7/ND with cadastral area 1522, with beneficiaries citizens Ardjan Mesiti and Ndue Mesiti.
