Analyst Andi Bushati reacted today after the incident that occurred on the show "Të Paekspozuarit", where he left the studio in anger, after being interrupted by journalists Ola Xama and Klodiana Lala. Bushati says that he would not have dealt with this event at all, which he describes as a "banal incident", if the circumstances that led to it had not been important.
In his reaction, Bushati emphasizes that his intention was to raise some questions on the topic under discussion, "Pëllumb Gjoka between SPAK and GJK", and that he did not want to contradict the other guests, but simply to reflect some important dilemmas regarding the issue.
He emphasizes that the studio debates were filled with emotion and hysteria, and that the populist mindset that prevails on some television stations has led to an attempt to conform to what is populist and popular in the polls, washing away
FULL RESPONSE:
This morning when I opened my cell phone, I found myself faced with an abnormal flood of messages, almost all of which were related to the unpleasant episode of my departure from Ylli Rakipi's show "Të Paekspozuarit". Some, starting with the video sequence of the program, lamented my plight for the miserable position I had ended up in, without letting me express a single thought, for almost half an hour. Others criticized me for the hot-tempered nature of my departure from the studio and for the vocabulary I used while doing this.
A third party justified me by consoling me that no one has to stand like a log in an arena, where logic is condemned to be killed at all costs, by the hysteria of populist cries.
I would not have bothered with this banal incident at all if the circumstances that led to it had not been fundamentally important. We had gathered at the table to discuss an event shrouded in the halo of a scandal: the release of the document that SPAK had wiretapped a member of a Constitutional Court, in a case in which the Special Prosecution Office itself was a party: that of the accused of serious crimes, Pëllumb Gjoka.
The central topic was whether the SKY ECC wiretaps would be used to keep him in prison, or whether they would not be considered as evidence, thus paving the way for the innocence of many criminals and politicians caught in the net of French and Belgian investigators. So the issue was of particular importance. Given this, SPAK, for whom this data is extremely important for a series of major processes, rightly suspected that there may have been pressure from gangs and politics to undo the data extracted from encrypted phones. They claim that they have had indications that powerful people have attempted to corrupt judge Gent Ibrahimi, which is why they decided to wiretap him, for 15 days, in the period between the 8-0 decision against Pëllumb Gjoka, i.e. leaving him in prison, and the time it took to justify this decision.
One of the arguments of SPAK's strong suspicion is that the Constitutional Court must clarify decisions within thirty days and has already exceeded this one-month period.
This is more or less the complicated event summarized in the most publicized way possible.
I had to express myself about it, too, after having patiently listened to all the speakers, including the host of the show, who justified SPAK's actions. Personally, I was not completely against what had been said with such zeal and pathos about the work of "our children's heroes". Even in my mind, the doubt swirled that SPAK could be right, since the political-financial pressure of criminal groups to invalidate the mountain of wiretaps found on Sky ECC will have unimaginable consequences.
But along with this conviction that I shared equally with others, I also wanted to express some doubts that I think constitute the DNA of every journalist who has decided not to serve as anyone's parrot. So I didn't want to contradict anyone, simply to raise some questions such as:
Can a prosecutor, who before the judge, formally, is in an equal position with even the biggest criminal, have an advantage by eavesdropping on the arbitrator who will decide in the process to which he is a party? So, even though it is known who Pëllumb Gjoka is, does he also have the right to an equal and fair process, where the prosecutor does not have the weapon of blackmailing the judge in his hand?
SPAK's defenders say that he acted within the law, but should we so easily accept an act of wiretapping decided by a prosecutor without a court decision? Are they right when they say that after 24 hours the court should validate this?
SPAK argues that the disclosure of the reasoning by the constitutional court was delayed beyond the 30-day deadline, implying that corruption may be suspected here. But in how many such cases has this court acted like this? Haven't the decisions on Berisha or the Electoral Code also been disclosed much later than the expected deadline. Shouldn't the constitutional judges also be put under wiretapping here?
Dhe së fundi, tani gjithçka ka përfunduar dhe vlefshmëria e malit me fakte të Sky ECC nuk është zhbërë, a duhet ta dimë se cila qe indicia që e vuri nën përgjim Gent Ibrahimin?
Pa e pasur këtë transparencë nga ana e SPAK, pa e ditur se cilat qenë rrethanat e ngjarjes, personat që ndërhynë dhe paratë që u premtuan për të infuencuar një vendim të rëndësishëm gjykate, pra pa u ditur të gjitha këto që çuan në këtë vendim ekstrem për përgjimin e Ibrahimit ne nuk mund të mbërrijmë në konkluzionin se cili ka të drejtë. Unë përpiqem të mos bëj pjesë tek ata gazetarë që nxjerrin konkluzione pa ditur provat. Dhe pa qenë në djeni të tyre nuk mund të thoja nëse SPAK kishte vepruar në mënyrë korekte dhe legjitime apo thjeshtë e kishte përdorur të gjithë këtë si shantazh për të marrë vedimin që i duhej?
Kaq doja të thoja. Këto dilema u mundova të ngrija, më kot. Por në një atmosferë të kapluar nga histerizmi kjo u bë e pamundur. Pse? Sepse derejtuesi i emisionit shpalosi devizën: më mirë të përgjojë SPAK-u se sa të fitojnë kriminelët. Sepse në krah kisha një kolege që rekej të përligjte normalitetin e përgjimeve pa vendim gjykate. Sepse përballë gjendej një politikan, që arsyetonte se për të mbrojtur SPAK-un nuk kishte nevojë që të dinte faktet që dispononte prokurori, pasi midis Prokurorisë Speciale dhe Kushtetueses ai personalisht kishte vendosur ti besonte të parës.
‘Kjo mendësi prej kasapësh në mbrojtje të “heronjve të fëmijëve tanë” me mbështetje të gjërë në sondazhet popullore, ma bëri të pamundur qoftë dhe artikulimin minimal të dilemave që me shqetësonin. E në këto kushte i rashë me grusht tryezës dhe u largova.
Por ky akt gjaknxehtësie, që mund të marrë shumë më tepër klikime sesa një shqetësim racional, në botën efemere të rejteve sociale, është krejtësisht i papërfillshëm në raport me mendësinë që u bë shkas për provokimin e tij. Dhe kjo mendësi buron nga prirja populiste që po mbizotëron në pjesën dërrmuese të studiove televizive për tu konformuar me atë që del e pëlqyer në sondazhe.
Natyrisht unë jam i ndërgjegjshëm se një pjesë e madhe e publikut e sheh SPAK-un si një instrument hakmarrjeje. Të vjedhur, të nëpërkëmbur e të padëgjuar për tre dekada, instikti i tyre i revanshit përkëdhelet sa herë që dëgjojnë për izolimin e Berishës, rrëmbimin si bandit të ish presidentit dhe plasjen e tij në burg, rrënien dramatike të “zdromsit” të Tiranës dhe denigrimin e tij përmes publikimit të fturave marramendëse të mbathjeve dhe sytjenave që ka blerë e shoqja.
Por duke e kuptuar këtë, vijoj të këmbëngul se para se të konformohet me instiktet e hakmarrjes, një gazetar duhet të kërkojë faktet, një vëzhgues i ndershëm dhe neutral duhet të ketë qëllim të vërtetën, një njeri me formim intelektual duhet të shtrojë pyetjen se ç’do të pjellë më pas kjo dallgë populizmi.
These concerns are being silenced and are falling prey to unconscious censorship in the arena of our public debate. Therefore, to make them even slightly audible, sometimes you have to bang your fist on the table. Or even walk away from it when those present are uninterested in calling for the help of reason.
