Celibashi: We are working with the DP to enable electronic voting in Tirana district

For the first time, Albania is expected to include the voting of immigrants in next year's elections, and the State Election Commissioner Ilirian Celibashi expressed optimism that the Regulatory Commission will approve the necessary acts to make this process possible.

" It is clear that the relatively tense political climate in Albania does not help the electoral preparation process in general, but until the moment we speak, it does not seem that this has affected the process of approval of acts by the Regulatory Commission and in general other regulatory aspects or preparatory, which the Central Election Commission has responsibilities delegated by the Electoral Code", he said.

While the political parties in Albania did not reach an agreement on the number of districts where voting and electronic counting would be carried out, in the interview for Voice of America, Mr. Celibashi said that he is working with the representatives of the Democratic Party and other parties who are skeptical, with the aim to implement electronic voting in the district of Tirana. "It remains a condition that there is an agreement from the entire opposition spectrum regarding this process, even though the considerations of either the Democratic Party or someone else regarding electronic voting are not related to the system itself, but to the approach of the technical staff to this system ", he said.

Voice of America: Mr. Celibashi, for the first time Albania is expected to include the vote of immigrants in next year's elections. How has the process of preparing the necessary infrastructure progressed so far when we are separated by about 6 or 7 months from the elections?

Ilirijan Celibashi: Considering the time we have to prepare this process, I can say without fear that it has gone well. At the moment we speak, the Regulatory Commission, which has certain powers assigned by the Electoral Code in terms of approving regulatory acts, has succeeded in approving two of the four or five acts that I, as State Commissioner, have proposed and will propose to this body that in the coming days three more acts will be passed.

Voice of America: Do you think there is a risk that the tense climate between the parties will affect the timely approval of technical voting procedures from abroad?

Ilirjan Celibashi: It is clear that the relatively tense political climate in Albania does not generally help the electoral preparation process, but until the moment we speak, it does not seem that this has affected the process of approval of acts by the Regulatory Commission and in general the aspects other regulatory or preparatory, which the Central Election Commission has delegated responsibilities by the Electoral Code.

Zëri i Amerikës: Zoti Celibashi, siç dhe ju e keni bërë dhe publike, duket se për një tjetër element, atë të votimit dhe numërimit elektronik nuk ka një dakortësi politike. Ju propozuar shtrirjen e tij fillimisht në 5 qarqe, u detyruat ta reduktonit këtë propozim në 2 të tilla, por demokratët duket se janë kundër. Si do veprohet, apo rrezikon që një votim i tillë të mos zbatohet?

Ilirjan Celibashi: Natyrisht, që zhvillimi i këtij procesi, i kësaj mënyre të votimit e ka në themel kërkesën për një konsensus sa më të gjerë të faktorit politik. Për sa kohë që partia kryesore e opozitës, Partia Demokratike nuk ka dhënë një mbështetje, kam frikë se ne si institucion përgjegjës për përgatitjen e procesi zgjedhor nuk mund të ecim përpara. Gjithsesi, do të duhet ta them dhe ta bëjë publike se do të vazhdojmë të punojmë me përfaqësuesit e Partisë Demokratike dhe ndonjë partie tjetër, e cila ka një lloj skepticizmi për votimin elektronik, që të mundësohet.

Do të ishte mirë edhe për atë që përfaqëson nga pikëpamja politike dhe elektorale qarku i Tiranës, por edhe për faktin që shumica dërrmuese e faktorit politik në Shqipëri e mbështet zhvillimin e votimit elektronik në Tiranë, mund të konsiderojmë opsionin e zhvillimit të votimit elektronik në qarkun e Tiranës. Por, gjithsesi ngelet kusht që të ketë një dakordësi nga gjithë spektri opozitar në lidhje me këtë proces edhe pse konsideratat e qoftë Partisë Demokratike apo të dikujt tjetër në lidhje me votimin elektronik nuk lidhen me sistemin në vetvete, por me qasjen e personelit teknik ndaj këtij sistemi. Përsëri, mendoj që është e rëndësishme që të adresohet ky shqetësim dhe të shpresojmë që në një moment të dytë të ekzistojë edhe mirëkuptimi dhe konsensusi i të gjithëve për këtë proces.

Zëri i Amerikës: Pra, bëhet fjalë vetëm për qarkun e Tiranës?

Ilirjan Celibashi: Për kohën që kemi në dispozicion, si dhe duke konsideruar se thuajse të gjitha partitë e tjera politike, përfshirë atë të shumicës së qeverisë, Partinë Socialiste dhe ato të opozitës, kanë propozuar dhe fortë kanë rekomanduar që votimi elektronik të zhvillohet në Tiranë, duke konsideruar këtu edhe elementë të tjerë, qoftë politik edhe elektoral apo edhe të logjistikës. E para me kohën që kemi në dispozicion mendoj që do të ishte me dobi që të zhvillohej votimi elektronik në qarkun e Tiranës. Por, gjithsesi do ta bëjmë këtë diskutim në ditët në vijim.

Zëri i Amerikës: Zoti Celibashi, financimi i Partive politike ka qenë gjithnjë një pikë e e dobët në Shqipëri. Legjislacioni aktual, sa garanton transparencën e partive, veçanërisht gjatë fushatave zgjedhore, për më tepër kur shihet gjithnjë e më tepër shfrytëzimi i platformave sociale?

Ilirjan Celibashi: Ligji, legjislacioni shqiptar krahasuar me të shkuarën ka goxha progres dhe ka krijuar kushte për një imponim ndaj subjekteve zgjedhore për të raportuar dhe mbikëqyrur paratë që ato marrin për fushatën zgjedhore apo në përgjithësi për aktivitetin politik. Por, eksperienca tregon që ka akoma vend për përmirësim. Duhet ta pranojmë të gjithë, ka indikatorë që na thonë këtë, që shpenzohen më shumë para sesa deklarohen. Kjo do të thotë që ka nevojë për të përmirësuar kuadrin rregullator, por ndërkohë edhe për mekanizma më efiçentë të kontrollit dhe të mbikëqyrjes. Aktualisht sot, Komisioni Qendror i Zgjedhjeve bën vlerësim të asaj se nga i marrin, ku i marrin dhe si i shpenzojnë partitë për kandidatët, kryesisht bazuar në deklarimet e tyre. Por, jo gjithmonë të dhënat që ato paraqesin janë të përputhura me realitetin.

Zëri i Amerikës: Zoti Celibashi, deri ku do të shtrihen këto mekanizma që ju i sugjeroni, përfshirë aktorë dhe institucione të tjera? A do të ketë shtrëngim të masave ligjore dhe atyre ndëshkuese?

Ilirjan Celibashi: Edhe ky është një aspekt, i cili do të duhej të rikonsiderohet. Pra, çështja e masave dhe sanksioneve. Por, ajo çfarë është më e rëndësishme është mekanizimi që ne do të duhet të kemi në dispozicion, që realisht ne të monitorojmë dhe kontrollojmë dhe të hetojmë mbi këtë çështje. Natyrisht ka aspekte të financimit, kryesisht ato që lidhen me financimet e huaja, të cilat mund të adresohen nga organe të tjera shtetërore, kryesisht ato të ndjekjes penale. Por edhe në aspektin administrativ, mendoj që do të duhet që mekanizmi i kontrollit dhe i monitorimit të jetë më efiçentë dhe të mos ngelet vetëm në një kuadër formal të këtij monitorimi dhe investigimi.

Zëri i Amerikës: Praktikisht, ju po thoni se keni nevojë për një zgjerim të tagrit ligjor për institucionin që ju drejtoni?

Ilirjan Celibashi: Pikërisht, kështu është.

Zëri i Amerikës: Do të merrni një iniciativë për këtë? Keni gjetur mbështetje nga aktorët?

Ilirjan Celibashi: Kemi bërë disa propozime, menduam që në kuadër të reformës zgjedhore partitë politike, veçanërisht dy kryesoret, Partia Socialiste dhe Partia Demokratike, do t’i adresonin këto rekomandime tona, por ngelën vetëm në kuadër të adresimit të vendimeve të Gjykatës Kushtetuese dhe nuk adreson asnjë prej çështjeve të tjera të cilat nuk ishin të trajtuara nga vendimet e Gjykatës Kushtetuese. Do të kishte qenë shumë mirë, edhe pse përsëri duhet ta them që koha për t’i implementuar këto rregulla ishte dhe ngelet mjaft e ngushtë, por do të kishte mirë sepse do të përmirësonin akoma më shumë standardin e këtij aspekti.

Zëri i Amerikës: Zoti Celibashi, a garanton i ashtuquajturi ligj për dekriminalizimin shmangien e kandidatëve me rekorde kriminale. Për më qartë, mund të jetë përbërja e parlamentit të ri të Shqipërisë më e pastër?

Ilirjan Celibashi: It can be said with complete certainty that the decriminalization law has made the contribution it should have made and I think, at least in my judgment, this is a personal opinion, that the composition of the parliament is very different today from that of in the past and certainly in the future it will be qualitatively different, qualitatively in terms of what the decriminalization law tries to regulate.

Voice of America: The electoral reform was truncated and mostly a political compromise to implement, as you mentioned a little earlier, the decisions of the Constitutional Court. What are currently the most immediate issues that require intervention in the electoral law, in your opinion?

Ilirjan Celibashi: In addition to issues related to the financing of political parties and electoral campaigns, the issue of electoral administration remains important. Electoral administration will continue to remain the domain of political parties only. I have said many times publicly that the standard of the electoral process will not be positively impacted by this form of administration of the electoral process. Political parties have many rights, but take few responsibilities.

Voice of America: Do you think it would be an intervention in the law that would have a spirit of consensus in the midst of a tense climate or will it go as it has traditionally happened in Albania, that interventions in the electoral law are done in the last minutes, Mr. Celibacy?

Ilirjan Celibashi: The time does not promise to make changes of this nature because it will have to be a complete political consensus. On the other hand, I am not in favor of political parties being completely stripped of their right to be in the administration of the electoral process, but they should have limitations in the administration of the electoral process.
