The court rejects the request for reopening the judicial review, Laert Haxhiu in GJKKO: I am being punished without facts!
Laert Haxhi's lawyer, Detar Hysi, requested today in the GJKKO Appeal that the judicial review be reopened.
"The prosecutor's office has not carried out any investigative action. This also applies to the special prosecutor, who has carried out 0 investigative actions, in the charge that is evaluated in this process. He performed only 3 non-investigative procedural actions. I asked for the floor to guide the court, before it acts on our request. It is the first case in the history of this building, that charges are filed without investigative action. I request the appointment of an expert in the relevant field. To examine the footage of the fuel, to determine whether Laert Haxhiu is in the vehicle or not. An expert report should be made by an expert in order to clarify the truth. The purpose of conducting the expert report is to discover the truth, if the people who appear in the footage of the gas station are Laert Haxhiu and Bilbili," said Hysi.
Laert Haxhiu, sentenced to life imprisonment by the Court of First Instance for the "Lushnja Massacre", said in the courtroom that he is being sentenced without facts and evidence.
"I am being punished unjustly and without facts. I agree with the request of the lawyer", said Haxhiu.
Even the prosecutor Altin Dumani rejected the claims that during the trial in the first instance, the evidence requested by the defense was not accepted.
"These images are not a single piece of evidence. The parties, the prosecution and the lawyer under the direction of the court had the opportunity to listen to the witnesses. It is not true that the evidence requested by the defense was not accepted during the trial in the first instance", said Dumani.
In the end, the court rejected the request for reopening the judicial review.
