Property report: Cadastral maps one of the most acute problems affecting Tirana

The Office of the People's Advocate has underlined that the respect of property rights as one of the fundamental rights remains at worrying levels in our country. In the annual report of 2021, the Institution of the People's Advocate identifies the cadastral maps as one of the most acute problems.

According to the report, they often do not match the situation of real estate on the ground, while it is about the most important areas of the territory, such as Tirana and the coast.

In many cases, when there are different copies of a map sheet, it is questionable which map is current or accurate. In the offices of ACA, data on parcels are not missing, but the exact status of the property is not known ", the report states. 

The most common problem is that real estate units (plots and buildings) are in many cases misplaced. Over time due to changes in specifications and reference, the problem has increased. In many cases, when there are different copies of a map sheet, it is questionable which map is current or accurate.

In the offices of ACA, data on parcels are not missing, but the exact status of the property is not known, the Ombudsman further states in the report. This situation is generally more complicated in urban areas, especially in and around Tirana, as well as in larger coastal areas, where there is a lot of informal construction.

Errors in property registrations are generally reflected in incorrect boundary, parcel size and ownership documentation. "Errors are usually detected at the time of a transaction in the relevant real estate unit as the property owner or border owners are not aware of the errors in the cadastral records on the assets," the report states.

Another issue highlighted by the People's Advocate over the years and continues to be present, is the expropriation of public property by the state in the public interest, where the report states that citizens feel powerless and do not care about their property interests. 

The issue of registration in the real estate register of the State Cadastre Agency of 26 thousand decisions issued over the years by the Property Treatment Agency for the recognition of property with the right to compensation remains unresolved today, the Ombudsman emphasizes, advising that owners to be compensated with state land and not with cash, which would severely affect the state budget.
