Gjyqi në Hagë/ Prokuroria kërkon vazhdimin e masës së

Zyra e Prokurorit të Specializuar (ZPS) ka dorëzuar para Gjykatës Speciale parashtresat për shqyrtimin periodik të paraburgimit për Hashim Thaçin dhe Kadri Veselin.

Me anë të këtyre parashtresave ZPS kërkon që të vazhdohet masa e paraburgimit.

Sipas ZPS-së që nga vendimi më i fundit i këtij Paneli më 17 prill 2023, nuk ka pasur asnjë ndryshim në rrethanat që meritojnë devijimin nga ai vendim duke shtuar se ecuria e vazhdueshme e gjykimit dhe zhvillime të tjera të rëndësishme do të vazhdojnë t’i japin Thaҫit dhe Veselit akses të mëtejshëm në informacione në lidhje me dëshmitarët e ndjeshëm dhe çështjen kundër tyre e që kjo sipas tyre shfaq domosdoshmërinë dhe arsyeshmërinë e paraburgimit.

Sipas tyre, ekziston dyshimi se Thaçi dhe Veseli janë përgjegjës për krime kundër njerëzimit dhe krime lufte. Po ashtu thuhet se tri arsyet që justifikojnë ndalimin janë: 1) rreziku i arratisjes; 2) pengim i mundshëm; dhe 3) rreziku i krimeve shtesë, e që këto sipas ZPS-së janë mundësi reale.

It is also said that the combination of continuing to gain a fuller knowledge of the case against them, seeing the fact that incriminating evidence enters the record, and being made aware through the Mustafa case of the real possibility of a lengthy sentence, raises the risk according to the ZPS of Thaçi and Vesel to leave.

ZPS claims that Thaçi and Veseli continue to pose a risk of obstructing the procedure.

According to them, this Panel has previously ascertained that the risk that Thaçi and Veseli could hinder the progress of the procedure in the SC and that the Office of the Specialized Prosecutor believes that such a risk continues to exist.

Also, it is said that the SPS thinks that there is still a risk of committing other crimes and since this panel has found such a risk in advance, according to them there is no change in circumstances from the last finding related to this issue and that this also includes the general climate of witness intimidation regarding KLA crimes.

Therefore, taking into account these same and additional factors, the detention of Thaci and Vesel according to the ZPS continues to be reasonable.

Otherwise, the Office of the Specialized Prosecutor, on September 30, 2022, submitted the confirmed amended indictment against Hashim Thaçi, Kadri Veseli, Jakup Krasniqi and Rexhep Selimi, which consists of ten counts, where the latter are charged with war crimes and crimes against humanity.
