Judicial confrontation with OSHEE, Bardhi is declared innocent

The Special Court of First Instance for Corruption and Organized Crime declared Gazment Bardhi innocent of the accusation of the company "KESH" sh.a., for the criminal offenses of "Defamation" and "Insult".

The head of the DP Parliamentary Group denounced on October 18 of last year at SPAK and then at a press conference the abuses of the companies KESH sh.a. and OSHEE Group sh.a., which amounted to 180 million euros.

According to Bardhi, the main person responsible for theft and abuse in the energy sector is Deputy Prime Minister Belinda Balluku and her subordinates who run public companies.

Prosecutor Sotir Kllapi: "Taking into consideration the public position of the accused and the fact that he is a central figure of the DP, we believe that the statements of the accused Gazmend Bardhi are due to the public function he holds. The fact that Bardhi has officially addressed his claims to SPAK and that the prosecutor has registered a criminal proceeding does not mean that the criminal offenses of "Defamation" and "Insult" have been consumed just because he has publicly declared something that he has also reported to SPAK. We request that Gazment Bardhi be declared innocent. It does not result in the commission of criminal offenses by him. The statement is nothing more than the reading of the report that Gazmend Bardhi has filed with SPAK."

Gazmend Bardhi's lawyers: The MP cannot act as a prosecutor or investigator. Gazmend Bardhi's actions were prudent. The purpose of the statements was to protect the state budget. It was a guarantee for public opinion. In our assessment, this guarantee was not respected. OSHEE sued Bardhi for defamation regarding a statement he made in Parliament on the percentage of losses in the energy network. The black squads have withdrawn for a decision.
