The legacy of Italian Baroness Anna Malfatt, who passed away in 2023 at the age of 87, has sparked a fierce judicial clash between her eight grandchildren and the 44-year-old Albanian guardian, to whom the baroness left all her wealth. In the will, drawn up in March 2022, she declared the guardian the sole heir of an estate that includes about one million euros in cash and six apartments, with a total value of nearly five million euros.

Two parallel processes: civil and criminal

The relatives of the baroness, represented by lawyer Claudio Malfer, have questioned the validity of the will and have launched a civil process for its annulment. At the same time, they have also filed a criminal complaint against the guardian, accusing her of fraud and manipulation of an incompetent person.

According to the Prosecutor's Office of Roveretto, the Albanian woman took advantage of the baroness' aggravated mental state, convincing her to change the will in her favor and then sign a general power of attorney, which gave her control over the property.

Defence: Videos, witnesses and allegations of implicit racism

The guardian's defense lawyer, Nicola Canestrini, has described the accusations as unfounded and has emphasized that his client has not yet accepted the inheritance, precisely so as not to get involved in controversy without legally clarifying the situation.

He has brought to attention a video recorded in front of the notary on March 21, 2022, where the baroness can be heard mentioning the name of the guardian herself and clearly, showing that she was aware of the decision she was making. Canestrini added that numerous witnesses have offered themselves to testify on behalf of his client, including close friends of the baroness and shop owners she frequented.

The defence has also raised concerns about potential racist bias in the process, saying that the "family tradition" cited by the opposing side should not be used to exclude the guardian's real contribution to the Baroness' life.

Expertise and next steps

The prosecution has presented a psychiatric expertise based on documents collected posthumously, which suggests that the baroness was suffering from a deterioration in her mental state several months before her death in November 2023. Meanwhile, the court has ordered the preventive seizure of the property until a further decision.

On May 8, Investigating Judge Consuelo Pasquali is expected to decide whether the case will go to criminal trial and whether the grandchildren will be accepted to represent the civil party in the criminal proceedings.
