BIRN: State bureaucracy prevents women from breaking out of the vicious circle of violence

Liljana* was married four decades ago in a remote village of Shkodra and had only seen her husband once before the wedding. After marriage, she faced systematic violence. He was violent and an alcoholic, but the woman endured.

"I endured for the sake of the children, as I had a daughter and a son," she says.

But when she saw that her daughter was equally abused by her husband and her son was used by her alcoholic father to cover up his problems with the law, Liljana repented.

"My world collapses," she says when she recalls her husband passing responsibility for a plot of cannabis to her teenage son.

This event was her turning point. At the age of 58 she asked for a divorce and to prevent her daughter from making the same mistake as her, she supported him to separate as well.

"Where I lived, in that deep area, the word divorce was not known, especially for my age. I convinced the girl to escape the violence and I promised her support, the support I had been lacking," she recalls.

Mother and daughter live together today and Liljana takes care of her young grandson. But the woman still lives with the feeling of guilt for her children who grew up in a family with violence.

The family was helped by the Catholic Church and then by women's protection organizations, but they are only one of the 2,783 cases documented by the "Easy Steps" organization in the last 20 years in the Shkodra area alone.

Denada Shpuza, head of the "Hapa te Lehte" Social Center in Shkodër, told BIRN that despite the work done to help abused women, the bureaucracy and lack of attention continues to keep many of them in the vicious cycle of violence.

"In short, victims of violence are not treated as emergency cases, so it is difficult for them to break away from the vicious circle," says Shpuza.

Some time ago, the organization "Hapa te Lehte" presented the installation "2783", an artistic work embroidered in meringue with a length of 12 m and a width of 1.6 m that was placed in the lobby of the Shkodër Municipality to commemorate the 20th anniversary of the organization.

The work is embroidered with the initials of 2783 women and girls who have sought help against violence during these 20 years. 8 women and girls, including victims of violence, worked for the realization of this installation voluntarily for 3 months, a full 460 working hours.

This awareness effort, like many others before it, and the help provided by organizations against violence against women, do not seem to have alleviated the situation.

Shpuza told BIRN that January of this year started with high numbers of violence. According to her, in the month of January alone, the organization received 12 complaints of domestic violence and only 2 of these cases were issued with a protection order.

“Gjykata e Apelit Shkodër është zhvendosur në Tiranë dhe kjo bën që viktimat e dhunës të mos kenë mundësi financiare për të ndjekur procesin dhe kjo bën që të humbasin këtë të drejtë”, thotë ajo.

Sipas saj, viktimat e dhunës në familje në Shkodër kanë mundësi për të përfituar një vit nga bonusi i qerave, por edhe këtu ka një ngërç, pasi nëse kërkesa depozitohet në muajin shkurt ose muajt pasardhës, duhet pritur një vit tjetër kalendarik për të marrë miratimin në këshillin bashkiak.

Shpuza ankohet edhe për policinë, e cila kërkon që denoncuesja të ketë shenja të dukshme dhunë për të lëshuar një urdhër mbrojtje.

“Kjo është absurde, pasi dhuna është në forma të ndryshme dhe e them me dhimbje që dhunuesit janë sofistikuar, pasi kam asistuar raste ku viktimat kishin dëmtime të gjymtyrëve, por që nuk kishte shenja të dukshme dhune,” thotë Shpuza.

Divorci si pasojë e dhunës

Gjykata e Shkallës së Parë të Juridiksionit të Përgjithshëm Shkodër gjatë vitit 2023 ka shqyrtuar gjithsej 195 kërkesa për urdhëra mbrojtje dhe urdhëra të menjëhershëm mbrojtje. Nga këto raste, 48 janë dërguar për ndjekje penale dhe janë dënuar për ushtrim dhune në familje.

Edhe policia thotë se rastet janë gjithmonë të pranishme.

“Rastet e raportuara/denoncimet për veprën penale “Dhuna në familje” në Drejtorinë Vendore të Policisë Shkodër për periudhën janar-dhjetor 2023 janë 66 raste, nga këto kemi 41 persona të arrestuar dhe 25 që ndiqen në gjendje të lirë,” thuhet në përgjigjen me shkrim të policisë.

Avokatja Edlira Bylo, e cila trajton më shumë çështjet e dhunës në familje, pohon për BIRN se qarku i Shkodrës ka një rritje të kërkesave për divorc. Sipas saj nëse arsyet për divorc do të ndaheshin,  80% e rasteve janë viktima të dhunës në marrëdhëniet familjare edhe kur nuk deklarohen në kërkesë padi.

Avokatja Edlira Bylo, duke theksuar lidhjen midis kërkesave për divorc dhe dhunës në marrëdhëniet familjare, hedh dritë mbi një realitet kompleks, ku faktorë si emancipimi i gruas dhe ndryshimet në shoqëri kontribuojnë në zhvillimin e këtij fenomeni.

“Si avokate në mbrojtje të viktimave, konstatoj që dhuna, jo vetëm është një fenomen që shoqëron paditë që formulojmë prej vitesh, por shënon dhe një tendencë gjithmonë në rritje,” thekson ajo.

Bashkitë periferike pa buxhet

Në territorin e Bashkisë së Shkodrës, që nga viti 2015, është krijuar dhe vënë në funksion strehëza për rastet emergjente të dhunës me bazë gjinore. Strehëza menaxhohet në bashkëpunim me organizatën “Gruaja tek Gruaja”, por koha e qëndrimit atje është vetëm 72 orë.

In Shkodër there is also a long-term shelter for the treatment of cases of domestic violence of the "Papa Giovanni XXIII" organization, but the capacities there are limited.

The Municipality of Shkodra, for its part, has created and put into operation Community Centers "For the Family". Currently, 12 centers are in operation, 7 in the urban area and 5 in the administrative units. These centers offer information, counseling, guidance, child protection, services for children and families and similar services.

"The Directorate of Social Services, Housing and Public Health at the Municipality of Shkodër consists of 23 staff members, approximately 11 of them are directly involved with specific tasks in matters of domestic violence or gender-based violence", says the response of the Municipality of Shkodër.

But the situation is not the same in the deeper areas. The municipalities of Malësia e Madhe, Vau i Dejës, Puka and Fushë Arrëzi do not have an approved budget to help victims of domestic violence.

Malesi e Madhe Municipality, in an answer to BIRN, says that the help it provides is psycho-social service and transportation to accompany the victim to the shelter or even to the apartment to collect personal belongings. While explaining that they do not have a specific budget for domestic violence.

The institution of the Vau i Deja municipality also has no budget, but relies on the help of organizations supporting abused women. "Cases of domestic violence are followed by the coordinator for domestic violence, according to the work protocol for these cases and in cooperation with GTN, who, according to the risk assessment, each takes the role of managing and empowering the case. In most cases, the municipality cooperates closely with the organizations of the society, which focus on domestic violence, and the needs of the victims are covered by the budgets and financing provided by them", this municipality writes in response to the request for information.

The same situation occurs in the Municipality of Puka and Fushë Arrëzit. The Municipality of Pukë, for such cases, offers Economic Assistance in the amount of ALL 9900 per month for as long as the protection order lasts. "There are cases where we can hire them if it is possible according to their profession. It can also help them with a food package or psychological assistance," said the Municipality of Puka./Reporter.al
