3 buildings in Palasa legalized, ASHK officials, village mayor and builders are being taken to court

The Vlora Prosecutor's Office has sent 17 people to court for the legalization of 3 buildings in Palasa in violation of the law.

The prosecution announces that officials of the State Cadastre Agency (ASHK), the mayor of the village of Palasë and the builders are accused of the criminal offenses of 'Forgery of documents', 'Forgery of seals, stamps or forms' and 'Abuse of office'.

"From the investigations into criminal proceedings no. 814 of 2020, it resulted that citizens AV, AL and FK, have built 3 2-story buildings in the village of Palasë, Himara, without the permission of the competent authorities, for profit purposes. These persons, while carrying out the construction of the buildings without permission, have applied to the Vlora ASHK for their legalization and have filed falsified documents in the legalization file.

For this reason, citizens AV, AL and FK have been charged with committing the criminal offenses of "Illegal construction", provided for by Article 199/a/4 of the Criminal Code, "Forgery of documents", provided for by Article 186/2 of the Criminal Code and "Forgery of seals, stamps or forms", provided for by Article 190/1 of the Criminal Code.

In the framework of this proceeding, the chairman of the Palasë Village Presidency, citizen O.Dh., was also charged with the criminal offense of "Forgery of documents" committed by the person who has the duty to issue the document, provided for by Article 186/3 of the Criminal Code, committed 3 times, as well as the three experts IT, EP and DM, for the criminal offense of "Forgery of documents", committed by the person who has the duty to issue the document and in collaboration, provided for by Article 186/3 and 25 of the Criminal Code, committed 3 times, after they drafted documentation with false data in their content.

These documents contained false data regarding the construction time in order to be included in the legalization procedures, and these documents were subsequently submitted by the defendants AV, AL and FK to the Vlora ASHK and became part of the legalization file.

Likewise, it was proven that while the Prosecutor's Office at the Vlora Court of First Instance was conducting investigations into the perpetrators of these constructions, the Vlora ASHK legalized 3 buildings in violation of the law. The ASHK employees tasked with verifying the conditions and criteria for benefiting from legalization, it was proven that elements of the criminal offense of "Abuse of office" committed in collaboration, provided for in article 248 and 25 of the Criminal Code, committed 3 times, were consumed.

In connection with this crime, the following citizens have been charged: KT, Director of the Vlora State Civil Registry Office, EM, Head of the Cartography Sector at the Vlora State Civil Registry Office, EY, Head of the Property Transfer Sector at the Vlora State Civil Registry Office, TM, Specialist of the Property Transfer Sector at the Vlora State Civil Registry Office, SR, Cartographic Specialist at the Cartography Sector at the Vlora State Civil Registry Office, A,D., Field Specialist at the Legalization Sector at the Vlora State Civil Registry Office, FD, Head of the Legalization Sector at the Vlora State Civil Registry Office, MJ, Specialist in the Legalization Sector at the Vlora State Civil Registry Office, DM, Head of Cartography and Registration at the Vlora State Civil Registry Office, A.Rr., Head of the Legalization Sector and TH, with the duty of IT Specialist at the Vlora State Civil Registry Office," the announcement states.

It is also announced that a "preventive seizure" was imposed on the following immovable properties:

1. Property with no. 200/353, with a construction base area of ​​82 m2 and a total construction area of ​​195 m2, for residence 195 m2/ for activity 0 m2, with 2 floors and a construction plot area of ​​246 m2, built in ZK 2863, Palasë.

2. Property with no. 200/352, with a construction base area of ​​79 m2 and a total construction area of ​​192 m2, for residence 192 m2/ for activity 0 m2, with a number of floors 2 and a construction plot area of ​​237 m2, built in ZK 2863, Palasë.

3. Property with no. 200/351, with a construction base area of ​​82 m2 and a total construction area of ​​195 m2, for residence 195 m2/ for activity 0 m2, with a number of floors 2 and a construction plot area of ​​246 m2, built in ZK 2863, Palasë.
