DP publishes documents: Contract with DHL was violated, CEC responsible for

Genta Vangjeli, Spokesperson for Anti-Corruption at the Democratic Party, has accused the CEC of being responsible for the failure of the external voting process. 

In a statement to the media, Vangjeli said that the contract with DHL was violated and the subcontractors operated in violation of the law, for the postal service of voters abroad. She added that the DP will pursue all legal procedures regarding the financial and electoral damage that resulted.

Full statement:  

On April 7, 2025, the Public Procurement Agency published in its bulletin no. 16, the data regarding the procurement procedure with negotiation without advertisement conducted by the Central Election Commission with the object: "Postal service for voters from abroad" worth 11 million euros including VAT which go to DHL International Albania.

Let's focus on the contract terms predetermined by the CEC.

The CEC itself has clearly stated that DHL International Albania will not be allowed to subcontract other entities or support entities in the implementation of this contract.

Now let's go to Talulant Balla's posts, but not only on his FB network, dated May 2, 2025, where it is written:

As for the company ????????????, this company only accepts deliveries to some remote areas. ?????????????????????? ,

Taulant Balla, the Socialist Party branch in Greece, SP exponents and MPs, and even the Albanian Embassy in Greece itself, how did they know this information about subcontractors and other details of their organization and contacts?

We are clear about the SP, but the Central Election Commission itself has violated:

1. Electoral Code Article 25/1:
The CEC could not entrust the service to any local operator and this legal obligation is not an alternative choice.

2. In accordance with and in implementation of the Electoral Code, the decision of the regulatory commission no. 13 dated 12.11.2024 on the approval of the rules for the procedure for voting from abroad, in the section "Sending electoral documentation to the voter", clearly stipulates that:

2.1. The electoral documentation is sent to the voter from abroad individually.
2.2 The documentation is sent to the address declared in the PER by the voter himself.
2.3. The sending of the electoral documentation is done through an express postal service that allows tracking of the shipment.

Under these conditions, Mr. Ilirjan Celibashi, as State Election Commissioner and executive director of this institution, had the obligation to ensure that:

* The contract concluded with the selected operator (in this case DHL) was in full compliance with the above-mentioned legal and sub-legal criteria;
• To take immediate measures at the moment of the news that DHL was operating with subcontractors
* To monitor the implementation of these legal obligations and contractual obligations at all times;
* To guarantee the individual and traceable distribution of documentation to each voter registered in the Diaspora,
• Based on the information received from voters in the Diaspora, DHL did not ensure the identity of the recipient with an identification document, but was satisfied with showing up at the door of a person and left the envelopes without asking for a means of identification.
• The manner of implementation of the contract by DHL, which Mr. Celibashi spoke about at the media conference on May 22, should not be monitored and followed since the conclusion of the contract according to the plan drafted by the CEC in implementation of Article 107 of VKM no. 285/2021.

4. In addition to the failure of the process that resulted in this electoral farce, the CEC is responsible for the violation of the LPP, article 122/1, VKM no. 285/2021 for the approval of public procurement rules, article 73/1, article 89 points 2 and 4, article 107, and the violation of the contract itself no. 1358/20 dated April 4, 2025, concluded between the CEC CA and the Contractor DHL International Albania shpk, the implementation of which cost Albanians 11 million euros with VAT but which failed successfully.

Therefore, the DP will pursue all legal procedures regarding the financial and electoral damage that resulted.
