Abuse of office, the "most fashionable" criminal offense for state

Abuse of office continues to remain the dominant criminal offense among crimes committed by state employees and persons in public service. Data from the Prosecutor General's report for 2025 show that proceedings for "Abuse of office" have increased by 16.43% compared to 2024 and account for 91.01% of all proceedings for this group of criminal offenses.

According to the report, an overall increase of 11.22% was recorded in proceedings for criminal offenses against state activity committed by state employees or in public service during 2025. At the same time, proceedings sent to court increased by 21.52%.

The report also highlights a strong increase in the number of defendants brought to court. According to the data, this indicator has increased by 85.52% compared to 2024, while the number of people convicted by the court has increased by 60.44%.

Crimes committed by public officials accounted for 2.01% of all criminal proceedings registered in Albania during 2025, up from 1.97% the previous year. The crime rate per 100,000 inhabitants increased from 20.40 in 2024 to 23.06 in 2025.

After "Abuse of office", the next most common offense is "Committing arbitrary acts", which accounts for 6.42% of the proceedings in this group. However, proceedings for this offense have decreased by 10.26% during 2025.

Proceedings for failure to declare or falsely declare assets by public officials also show a sharp decline. According to the report, the number of proceedings for this criminal offense has dropped from 17 cases in 2024 to only 7 proceedings in 2025. This category accounts for only 1.28% of the group's proceedings, down from 3.47% a year earlier.

The profile of the defendants shows that the majority are men and have higher education. According to the data, 85.22% of the defendants are men and 14.78% are women. A full 75.57% of them have higher education, while 89.92% are ordinary administrative employees.

The report also highlights that 90.99% of defendants live in the city and 97.43% have no previous convictions.

Regarding criminal policy, prosecutors have requested a precautionary measure with arrest in 27.63% of cases, while courts have imposed arrest in 23.29% of requests.

Regarding sentences, in 97.31% of cases prosecutors have requested prison sentences and in only 2.69% a fine. On the other hand, courts have imposed prison sentences in 99.32% of cases. However, the report shows that for 25.33% of defendants the courts have found them not guilty.

In most cases, suspension of sentence and probation were applied. This measure was imposed on 82.76% of the defendants./ekofin.al
